CALLING AN ELECTION FOR JUNE 26, 1976, SUBMITTING THE
PROPOSITION OF WHETHER TO ISSUE C&LHUNITY- CONVENTION
FACILITY BONDS IN THE SUM OF $14 400 000 AND TO
,
AUTHORIZE LEVYING, ASSESSING AND COLLECTING AN ANNUAL
AD VALOREM TAX TO PAY FOR SAID BONDS; PRESCRIBING THE
USE OF VOTING MACHINES; SETTING OUT THE ELIGIBILITY
OF ELECTORS; PRESCRIBING NECESSARY NOTICE AND THE FORM
OF THE PROPOSITION TO BE SUBMITTED; AND DECLARING AN
EMERGENCY.

WHEREAS, it is deemed necessary and advisable to call the election
hereinafter ordered; and
WHEREAS, it is hereby officially found and determined: that the
public importance and pressing need for the permanent improvements to be
constructed by use of the proceeds of bonds contemplated to be voted create
an emergency and an imperative public necessity; and that said meeting was
open to the public, and public notice of the time, place and purpose of
said meeting was given; all as required by Vernon's Ann. Civ. St. Article
6252 -17, as amended; and
WHEREAS, this preamble constitutes and shall be regarded as an
integral part of this ordinance: x
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS: ' "•
1. That an election shall be held on June 26, 1976, in the
said City in the several regular election precincts of said City, at the
several regular polling places, conducted by the appointed election officials,
all as set out in Ordinance No. 13178, adopted by the City Council on May 12,
1976, a copy of which is attached hereto as Exhibit "A" and made a part
hereof by reference for all purposes.
2. Each Presiding Judge shall appoint not less,than two quali-
fied election clerks to serve and assist in conducting said election;
,provided that in each instance where the Presiding Judge actually serves
as expected, the Alternate Presiding Judge shall be one of such clerks.

3.* Voting machines shall be used both for

I absentee voting by personal appearance and for voting
at the regular polling places at said election; but paper
ballots shall be used for absentee voting by mail. A
Special Canvassing Board shall be appointed by the Mayor,
as provided by law, to count and canvass all absentee votes
and ballots cast at said election.
4. That all resident, qualified electors of

the City shall be entitled to vote at'said election.
5. That notice of said election shall be given
;I by posting a substantial copy of this Ordinance in each of
the Election Precincts of said City and also at the City

shall be published on the same day in each of two successive

ij said City, the date of the first publication to be not less

6. That at said election the following
PROPOSITION shall be submitted in accordance with law:
PROPOSITION
Shall the City Council of said City be authorized to issue
the bonds of said City, in one or more series or issues, in
the aggregate principal amount of $14,400,000, with the
bonds of each such series or issue, respectively, to mature
serially within not to exceed twenty -five years from their
' date, and to be sold at such prices and bear interest at
such rates as shall be determined within the discretion
of the City Council,-for the purpose of makinq permanent
public improvements, to -wit: A COMMUNITY - CONVENTION
FACILITY, INCLUDING AN EXHIBIT HALL, 14EETING ROOMS, BANQUET
HALL, ADDITIONAL AUDITORIUM IMPROVEMENTS, AND FURTHER
ACQUISITION AND DEVELOPMENT OF THE SITE, AT THE BAYFRONT
CENTER FOR THE ARTS AND SCIENCES; and shall said City
Council be authorized to levy and caused to be assessed
and collected annual ad valorem taxes in an amount sufficient
to pay the annual interest on said bonds and provide a sinking
fund to pay said bonds at maturity?
7. That the official ballots for said election shall be prepared
in accordance with the Texas Election Code so as to permit the electors to
vote "FOR" or "AGAINST' the aforesaid PROPOSITION, with the ballots to con-
tain such provisions, markings and language as required by law, and with
such PROPOSITION to be expressed substantially as follows:

COMMUNITY- CONVENTION FACILITY $14,400,000
The issuance of bonds in the amount of $14,400,000 for
constructing a community- convention facility, including
an exhibit hall, meeting rooms, banquet hall, additional
auditorium improvements and further acquisition and
development of the site at the Bayfront Center for the
Arts and Sciences.
PASSED AND APPROVED this the 2nd day of June, 1976.

SECTION 2. That a copy of this ordinance, signed by the Mayor of the
City of Corpus Christi, Texas, shall constitute notice of City voting precincts,
polling place locations and designation of election judges and alternates at
said election, and the Mayor is directed to cause a copy of this ordinance,
signed by him, to be posted at the City Hall in the City of Corpus Christi,
Nueces County, Texas, and to have a copy of this ordinance published in the
Corpus Christi Times, the official newspaper of the City of Corpus Christi,
Texas, it being a newspaper of general circulation, published within the City
of Corpus Christi, said publication to be made prior to the date of the holding
of general and special elections in 1976.

SECTION 3. The necessity to delineate City votino precincts, to
designate polling place locations, and to designate election judges and
alternates at the aforementioned elections creates a public emergency and
an imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction but that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared such
emergency and necessity to exist, and having requested the suspension of the
Charter rule and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and after
its passage and publication, IT IS ACCORDINGLY SO ORDAINED, this the 12th
day of May, 1976.

Council of the City of Corpus Christi, Texas, convened in
Regular Meeting, with the following members of said Council
present, to -wit:

constituting a quorum, at which time the following among other
business was transacted:
Mr. Luby, Mayor, presented for the consideration of
the Council an ordinance. The ordinance was read by the City
Secretary. The Mayor presented to the Council a communication
in writing pertaining to said proposed ordinance, as follows:

Gentlemen:
The public importance and pressing need for the per-
manent improvements to be constructed by use of the proceeds
of bonds contemplated to be voted pursuant to an ordinance
create an emergency and an imperative public necessity requir-
ing ordinances to be considered and voted upon at three regu-
lar meetings. I, therefore, request that the City Council
pass the proposed ordinance calling an election for the issu-
ance of said bonds as an emergency measure. You will please
consider this request in connection with the ordinance which
is to be introduced for passage by the City Council on this
subject.

provision prohibiting ordinances from being passed finally
on the date introduced be suspended for the reasons stated
in the written request of the Mayor and stated in the emergency
clause of the ordinance. The motion was seconded by Councilman

Lozano The motion was carried by an unanimous vote
by the City.Council, viz:
AYES: Councilmen De Ases, Gill, Lozano,
Sample and Tipton.
NAYS: None.
The Mayor requested that the records show that he
