HomeMy WebLinkAbout13233 ORD - 06/16/1976JKR:hb:6 /14/76:1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ACQUIRE PARCELS 1 AND 2, AIRLINE -PADRE ISLAND DRIVE TO WILLIAMS DRIVE STREET IMPROVEMENT PROTECT, NO. 220 -72 -8, AND TO EXECUTE SUCH DOCUMENTS AS MAY BE NECESSARY TO EFFECT THE SAID ACQUISITION; APPROPRIATING OUT OF THE NO. 220 STREET BOND FUND $35,000, OF WHICH $32,760 IS FOR ACQUISITION AND $2,240 IS FOR CON- TINGENCIES AND INCIDENTAL EXPENSES RELATED TO CLOSING, ALL IN CONNECTION WITH THE AFORESAID ACQUISITION; AND DECLARING AN EMERGENCY. . I ' . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to acquire Parcels 1 and 2, Airline -Padre Island Drive to Williams Drive Street Improvement Project, No. 220 -72 -8, from the owners, Texas Star Distributing Corporation and Corpus Christi Independent School District, respectively, said parcels being more particularly described as follows: PARCEL NO.1 Being an irregularly shaped tract of land out of Lot "A ", Bayder Addition as shown by map of record In Volume 26, Page 53, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at a point on the east right- of-way line of Airline Road, said point being the southwest corner of said Lot "A", Bayder Addition, for the southwest and beginning corner of the tract of land herein described; Thence N. 2° 28' 40" E., along the east right -of- way line of said Airline Road, a distance of 51.49 feet to a point for the P.C. of a curve; Thence to the right along the arc of a circular curve whose central angle is 116' 31' 20 ", radius 20.0 feet, tangent 32.33 feet, a distance of 40.67 feet to a point in the southwest right- of-way line of South Padre Island Drive; Thence S. 61' 00' E., along the southwest right -of- way line of said South Padre Island Drive, a distance of 6.71 feet to a point for the P.C. of a curve; Thence in a northwesterly direction along the arc of a circular curve to the left whose central angle is 116' 31' 20 ", radius 20.0 feet, tangent 32.33 feet, a distance of 40.67 feet to a point of tangency; MICROFILM ED Thence S. 2° 28' 40" W., along a line that is 6.0 feet east of and parallel to the east right -of -way JUN 16 1980 13233 line of said Airline Road, a distance of 51.49 feet to a point in the southwest boundary line of said Lot "A ', Bayder Addition; Thence N. 61' 00' W., along the southwest boundary line of said Lot "A ", a distance of 6.71 feet to the place of beginning and containing 512.63 square feet, more or less. PARCEL N0. 2 Being an irregularly shaped tract of land out of Lots 11 and 12, Section 13, Flour Bluff and Encinal Farm and Garden Tracts as shown by map of record in Volume "A", Pages 41, 42, 43, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at a point which bears S. 60' 59' 20" E., a distance of 18.55 feet, thence N. 29' 00' 40" E., a distance of 30.0 feet from the southwest corner of said Lot 11, said point being the intersection of the northeast right -of -way line of Williams Drive and the east right- of-way line of Airline Road for the southwest and beginning corner of the tract of land herein described; Thence N. 2' 28' 40" E., along the east right -of- way line of said Airline Road, a distance of 1,130.14 feet to a point for the most northerly corner of this tract; Thence S. 61' 00' 10" E., pass the southwest corner of Lot "A ", Bayder Addition as shown by map of record in Volume 26, Page 53, Map Records, Nueces County, Texas at 11.18 feet, in all a distance of 19.0 feet to a point on the southwest boundary line of said Lot "A "' s Thence S. 2' 28' 40" W., along a line that is 17:0 feet east of and parallel to the east right- of-way line of said Airline Road, a distance of 198.51 r "'• feet to a point; Thence S. 6' 28' 55" W., a distance of 100.24 feet to a point; Thence S. 2' 28' 40" W., along a line that is 10.0 feet east of and parallel to the east right -of -way line of said Airline Road, a distance of 821.97 feet to a point for the P.C. of a curie; Thence to the left along the are of a circular curve whose central angle is 63& 28' 00 ", radius 10.0 feet, tangent 6.18 feet, a distance of 11.08 feet to a point which is the P.T. of said curve, said point being in the northeast right- of-way line of said Williams Drive; Thence N. 60' 59' 20" W., along the northeast right - of -way line of said Williams Drive, a distance of 17.36 feet to the place of beginning and containing 13,063.65 square feet or 0.300 acres, more or less, -2- and that the City Manager is hereby authorized to execute such documents and instruments as may be necessary to effect acquisition of the aforesaid two parcels or tracts of land. SECTION 2. That there is hereby appropriated out of the No. 220 Street Bond Fund the sum of $35,000, of which amount $32,760 is for acquisition of the aforesaid parcels and $2,240 is for contingencies and incidental expenses related to closing. SECTION 3. The necessity to acquire the described parcels and to provide the necessary funds for their acquisition in order that the Airline -Padre Island Drive to Williams Drive Street Improvement Project may proceed without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the Ile day of JUNE- , 1976.
