WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of J. W. Miller for amendment to the zoning map of the City of Corpus Christi; and MIEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday May 26, 1976 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was I decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter_ set" out. Hart Partition, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "FR" Farm -Rural District to "R -IB" One- family Dwelling District and described as follows: Being a tract of land situated in Nueces County, Texas, containing 31.2 63 acres, more or less, out of the Gregorio Farias Grant, Survey No. 304, Abstract No. 606, and also being described as Share I and II of the C. C_ Hart Partition, as recorded in Volume 293, Page 425 of the Geed Records of Nusces County,Texas, also shmem as Share I and II on Map of "Partition of the lands of C. C. Hart, Deceased," recorded in Volume 289, Page 24 of the Lead Records of Nueces County, Texas, and being more particularly described by r -etes and bounds as follows, to -rtit_ BEGIN'NIiiG at an iron axle set in the westerly lire of said C. C. Hart lands at its intersection with the southerly r.o.ti. line o; Leopard Street, (State Highway 9), for the N51 corner oil this tract and the point of beginning; THENCE S 53° 23' 00" E along the southerly r.o.w. line of said Leopard. Street, (state Highway 9) a distance of 502.7 feet to a point marked by a 1" iron pipe for the N "c corner of this tract, also being tiie M14 corner of. Share III, said C. C. Hart Partition; THENCE S 17° 47' 29" W along the westerly line of said Share III, C. C. Hart Partition, at 620.6' past a 1" iron bar marking the SW corner of the J. W- Miller 1.4 acre tract, in all a distance of 1,222.52' o a point marked by a i/2" iron rod driven in the center of the remains of an old cedar post for an.inside corner of this tract, also being a corner of said Share III, C. C. Hari: Partition; THENCE S 22° 24' 37" W along the westerly line of said Share III, C_ C. Hart Partition, a distance of 1,728.00' to a point marked by a 1 -1/2" iron pipe, for the SE corner of this tract, also being the SW corner of said Share III, C. C. Hart Partition; THENCE N 53° 13' 51" 41, the northerly line of the Calallen Independent School Tract and along the southerly lire of said C. C. Hart Partition, a distance of 968.62' to a point marked by a 1" iron pipe for the KW corner of this tract; THEPiCE N 370 09' 32" E along the - easterly line of the Harney Partition, a distance of 275.50' to a point marked by a 1" iron pipe for a corner of this tract, also being a corner of the Harney Partition; THENCE S 53° 39' 38" E along the easterly line of said Harney Partition, a distance of 247.98' to a point marked by a 1" iron pipe for a corner of this tract, also teing a correr or said Harney Partition; THENCE t1 40° 15' 33" E along the easterly line of said Harney Partition a distance oT 1,145.07' to a point marked by a 1" diameter steel shaft for an inside corner of this tract, also baing a corner of said Harney Partition; THENCE ti 100 36' 24" E along the easterly line of said Harney Partition, a distance of 1,539.92' to the point of beginning and containing 31.263 acres of land, more or 1 ess. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public. emergency and an imperative puiblic necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City' Council., and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY 50 ORDAINED, this the 2� day of , 19, ATTEST: 'At& xl� City Secretary �qJ RAY OF , 19/6 J.
