HomeMy WebLinkAbout13250 ORD - 06/23/1976,jK11.0-ei- 10; ISL i t AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF J. W. MILLER BY GRANTING A SPECIAL COUNCIL PERMIT FOR AN OIL FIELD EQUIPMENT AND MAINTENANCE SERVICE ON 2.67 ACRE TRACT OR PARCEL OF LAND, MORE OR LESS, OUT OF SHARES III AND IV, HART PARTITION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS SET FORTH ON THE SITE PLAN, ATTACHED HERETO, MARKED EXHIBIT "A ", AND MADE A PART HEREOF, SUBJECT TO THE CONDITIONS SET FORTH HEREINAFTER; KEEPING IN EFFECT ALL OTHER PROVI- SIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of J. W. Miller for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday May 26, 1976 , at Special Council Pfeeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from titre to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter_ set out. That a Special Council Permit be granted for an oil field equipment and maintenance service on the hereinafter described parcel or tract of land out of Shares III and IV, Hart Partition, as the same appears in Vol. 293, page 424, Deed Records of Nueces County, Texas: Situated in the County of Nueces, State of Texas, and being a portion of that certain 5.35 acre tract described in deed from Laurie Price et al to Eugene H. Price, recorded in Volume 356, page 567, Deed Records of Nueces County, Texas; said 5.35 acre tract being out of the northeast portion of Shares Nos. III and IV of the partition of the lands of the Estate of C.C. Hart, Deceased, as shown by the Partition Deed recorded in Volume 293, Page 425, Deed Records of Nueces County, Texas, with accompanying plat of record in Volume 289, page 24, Deed Records of Nueces County, Texas, the same being a portion of Survey No. 304, Abstract No. 606 and 808 made for h;cCampbell and Givens by virtue of Certificate No. 1965, property hereinafter more particularly described by mmetes and bounds as follows, to -wit: BEGINNING at a 1" iron bar set at the northwest or most northerly corner of said Share III, the sane being also the most easterly corner of Share II of the aforementioned Partition of the Estate of C.C. Hart, Deceased, said iron bar being located in the south- west boundary line of the right of way for State Highway No. 9, for the northwest or most northerly corner of this tract; THENCE South 56° 23' east along said southwest boundary line of the right of way for State Highway No. 9 a distance of 208.38' to a 1" iron bar set flush with the ground, for the northeast corner of this tract, the same being also the northwest corner of a 1.00 acre tract designated Tract C out of Shares III and IV of said 5.35 acre tract; THENCE-7 South 17° 37' 40" west along the northwest boundary line of Share III for a distance of 434.22' to a 1" iron bar set flush with the ground, the same being also the southwest corner of a 1.00 acre tract designated as Tract C out of Shares III and, IV and of said 5.35 acre tract; THENCE South 56° 23' east with the southwest boundary line of said Tract, out of said 5,35 acre tract, and parallel with the northeast boundary line of said Shares III and I'i and of said 5.35 acre tract for a distance of 104.36', to a 1" iron bar, set flush with the ground in the northwest boundary line of a 1.68 acre tract, designated Tract D, out of said 5.35 acre and the south corner of said Tract C, for the east corner of this tract; THEE CE South 17° 37' 40" west with said northwest boundary line of Tract D and parallel with the northwest boundary line of said Share III and of said 5.35 acre tract, 54.28' to a 1" iron bar set flush with the ground on the west line of said Tract D for the south corner of this tract; THENCE North 56° 23' west parallel with and 30.40' northeasterly, measured at right angles from the southwest boundary lire of said 5.35 acre tract, 208.721 to a 1" iron bar set flush with the ground, for a corner of this tract; THENCE South 17° 37' 40" west with the northwest boundary line of said Tract A out of Share III and of said 5.35 acre tract, 131.5' to a point for the most southeast corner of said tract; THENCE North 56° 23' west along the southwest boundary lire of said tract, the sane being parallel to the northeast boundary line of the tract herein described, a distance of 104.02' for the southwest or most westerly corner of this tract; THENCE North 17° 37' 40" east along the northwest boundary line of said Share III and the southeast boundary line of said Share II for a distance of 620.06' to the place of beginning and containing 2.67 acres of land, more or less. -2- as more particularly described on the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit "A ", subject to all other conditions of "FR" Farm Rural District zoning, and further subject to the condition that the standard screening fence not be required along any portion of this tract until a residential development is built adjacent to this property. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the property included in the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit will be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Hap of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative puiblic necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect 0 0 from and a r its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of 4a4U--, 19 -/a ATTEST: City Secretary MAYOR THE CITY OF CORPUS CHRISTI, TEXAS APPROVED: 234 DAY OF '199 J.
