HomeMy WebLinkAbout13261 ORD - 06/30/1976TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS NECESSARY FOR THE ACQUISITION OF PARCEL NUMBER 3 FOR THE CORPUS CHRISTI BEACH RESTORATION PROJECT; APPROPRIATING $6,800 OUT OF 291 PARK BOND FUND, PROJECT NUMBER 291 -72 -11 IS FOR TEMPORARY CON- STRUCTION EASEMENT, AND FOR A QUITCLAIM DEED TO THE CITY QUITCLAIMING ALL TITLE AND INTEREST IN BLOCKS J AND K, BROOKLYN ADDITION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager is hereby authorized to c execute the necessary documents for the acquisition of Parcel Number 3 for the Corpus Christi Beach Restoration Project. This acquisition if for the temporary construction easement and for a quitclaim deed to the City quit- claiming all title and interest that Diboll Development and Luxury Lodges, Inc. SECTION 2. That there is hereby appropriated $6,800 out of No. 291 Park Bond Fund, Project No. 291- 72 -11, for the temporary construction ease- ment and for a quitclaim deed, quitclaiming unto the City of Corpus Christi all title and interest which Diboll Development and Luxury Lodges, Inc. might have in Blocks J and R, Brooklyn Addition. The property to be acquired by the City is as follows: PARCEL NO. 3 Being a tract of land out of Lots 7, 9, 11, Block 9, Brooklyn Addition, as shown by map of record in Volume A, Pages 30, 31, 32,Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at a point which is the northeast corner of Lot 11, Block 9, Brooklyn Addition, said point being the intersection of the southerly right -of- way line of Golf Place and the westerly right -of- way line of North Shoreline Boulevard, for the north- east and beginning corner of the tract of land here- in described; Thence S. 32•. 00' W. along the westerly right -of- way line of said North Shoreline Boulevard, passing the northeast corner of said Lot 9 at 50.0 feet, the northeast corner of said Lot 7 at 100.0 feet, in all a distance of 140.0 feet to a point; w1juROHNE5, 135G/ JUN 17 1980 THENCE N. 25° 53' 04" E., crossing the northerly boundary line of said Lot 7 at 40.23 feet, the northerly boundary line of 'said Lot 9 at 90.52 feet, in all a distance of 140.80 feet to a point on the northerly right -of -way line of said Golf Place; THENCE S. 58° 00' E. along the northerly right -of- way line of said Golf Place, a distance of 15.0 feet to the place of beginning and containing - 1,050.0 square feet, more or less; In addition, a quitclaim is to be obtained from the owners unto the City of Corpus Christi of all title and interest in and to Blocks J and K, Brooklyn Addition. SECTION 3.. The public importance and necessity for the City to gain immediate possession of the aforesaid- parcel or tracts of land as hereinabove described for said Project, and for other municipal purposes, as hereinabove described and provided, creates a public emergency and an imperative'public necessity requiring the suspension of the Charter rule that no ordinance.or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and of r its - passage, IT IS ACCORDINGLY SO ORDAINED this the JO day of 976.
