HomeMy WebLinkAbout13263 ORD - 06/30/1976EE:vp:6 /28/76:lst AN ORDINANCE ABANDONING THE EAST THREE (3) INCHES OF THE FIVE (5) FOOT DRAINAGE EASEMENT ADJACENT TO THE NORTHWEST PROPERTY LINE OF LOT 11, BLOCK 1, GREENWAY GARDENS UNIT 1, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS SHOWN BY PLAT RECORDED IN VOLUME 32, PAGES 1 AND 2, MAP RECORDS OF NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 5 -foot drainage easement along the northwest property line of Lot 11, Block 1, Greenway Unit 1, as shown by plat recorded in Volume 32, pages 1 and 2, Map Records of Nueces County, Texas, in the City of Corpus Christi, Texas; and WHEREAS, it has been determined that it is feasible and advan- tageous to the City of Corpus Christi to abandon the east three inches (3 ") of said utility easement to the owner of the abutting property: a NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY / OF CORPUS CHRISTI, TEXAS: SECTION 1. That the east three inches (3 ") of the five (5) foot drainage easement adjacent to the northwest property line of Lot 11, Block 1, Greenway Gardens Unit 1, in the City of Corpus Christi, Nueces County, Texas, as shown by plat of record in Volume 32, pages 1 and 2, Map Records of Nueces County, Texas, be and the same is hereby closed and abandoned for public use and every municipal purpose, and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City -- of Corpus Christi. SECTION 2. The fact that the public convenience and necessity would be better served by the closing of the aforesaid portion of the subject drainage easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduc- tion and take effect and be in full force and effect from and after its 13263 wouKaILMED, JUN 17 1980 passage, IT IS ACCORDINGLY SO ORDAINED, this the —50 day of June, 1976• ATTEST: All Clt' y Secretary�� APPROVED: 3D DAY OF J // +,,( 14 76 J.
