HomeMy WebLinkAbout13279 ORD - 07/07/1976:oc: 7/7/76 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ACCEPT CONSTRUCTION RIGHTS AND EASEMENTS FROM PROPERTY OWNERS OF CORPUS CHRISTI BEACH, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE DOCUMENTS NECESSARY FOR THE ASSIGNMENT TO THE UNITED STATES OF AMERICA OF CERTAIN RIGHTS AND EASE- MENTS FOR THE CORPUS CHRISTI BEACH RESTORATION PROJECT, ALL AS MORE FULLY SET FORTH IN THE TEMPORARY CONSTRUCTION RIGHT OF ENTRY, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to accept construction rights and easement from property owners of the Corpus Christi Beach, and that the City Manager be further authorized to execute the documents necessary for the assignment to the United States of America of certain rights and easements for the Corpus Christi Beach Restoration Project, all as more fully set forth in the Temporary Construction Right of Entry, a substantial copy of which is attached hereto, marked Exhibit "A ", and made a part hereof. SECTION 2. The necessity to authorize execution of the aforesaid documents in order that the Corpus Christi Beach Resto- ration Project may commence without delay creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read.at three several meetings, of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on MIUKUHLMED 13279 - JUN 171980 'i:oc:7/7/76 the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the _day of July, 1976. BRUCE AYCOCK, City Attorney By Assistant Attorney TEMPORARY CONSTRUCTION RIGHT -OF -ENTRY THE STATE OF TEXAS r COUNTY OF NUECES k T H I S grant from the City of Corpus Christi, Texas, hereinafter styled the City, to the United States of America, hereinafter styled the United States, W I T N E S S E T H: T H A T whereas, the City has assumed the responsibility of local cooperation required by the Federal project for restoration of Corpus Christi Beach which project was authorized in accordance with Section 201 of the Flood Control Act of 1965; and W H E R E A S, in such capacity, the City has acquired easements or other rights in the hereinafter described land which will support and are required for construction, operation and maintenance of said pro- ject; and W H E R E A S, it has now become necessary to temporarily assign said 'rights and easements to the United States in order to accommodate pro- ject construction; N O W therefore, for and in consideration of the benefits accruing to its citizens as the result of said project, the City does by these presents grant and assign unto the United States and its assigns, for the term hereinafter specified, in the lands hereinafter described, the right privilege and easement to enter thereon with men, material and equipment to perform all work related to construction of the project for restoration of Corpus Christi Beach as described in House Document Number 91 -415, 91st. Congress, 2nd. Session, and in Design Memoranda approved by the Chief of Engineers, which documents are incorporated herein by this reference.
