MOORE AND JULE PELS, A PARTNER- SHIP, DEVELOPERS OF CRESTMONT SUBDIVISION, WHEREBY THE CITY WILL REIMBURSE THE DEVELOPERS ONE -HALF OF CONSTRUCTING STREET IMPROVEMENTS AROUND THE DEDICATED PARK ABUTTING BLOCK 6 IN CRESTMONT SUBDIVISION; ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUB- STANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; APPROPRIATING $2,800.04 OUT OF THE NO. 220 STREET BOND FUND FOR THE CITY'S ESTIMATED SHARE OF COST APPLICABLE TO PROJECT NO. 220- 72 -29; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS : SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with Edgar H. Moore and Jule H. Pals, a partner- ship, developers of Crestmont Subdivision, whereby the City will reimburse the developers one -half the cost of constructing street improvements around the dedicated park abutting Block 6 in Crestmont Subdivision, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. That there is hereby appropriated out of the No. 220 Street Bond Fund the sum of $2,800.04 for the City's estimated share of street improvement construction costs applicable to Project No. 220- 72-29. SECTION 3. The necessity to authorize execution of the afore- said agreement and to appropriate the sums necessary to reimburse the developers for the City's share of construction costs in connection with street improvements around the said dedicated park situated in the City of Corpus Christi, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule MICROFILMED JUN 16 1980 and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the ,day of July, 1976. BRUC /(E AYCOCK, CITY ATTORNEY By ! /� //(/sJ��/ // Assistant Attorney AGREEMENT THE STATE OF TEXAS X COUNTY OF NUECES X This agreement is entered into between the City of Corpus Christi, hereinafter called "City ", and Edgar H. Moore and Jule H. Pels, a Partnership, developers of Crestmont Subdivision, hereinafter called "Developers ". WHEREAS, Developer in compliance with City's Platting Ordinance, Section TV, Subsection F., has dedicated a portion of Crestmont Subdivision, Unit 1, Block 6, for use as parks and playgrounds; and WHEREAS, City's Platting Ordinance provides that City shall bear its portion of the cost of curb and gutter and pavement on any street bounding a park being dedicated. NOW, THEREFORE, City and Developer agree as follows: 1. Developer will construct certain improvements for and on behalf of City including curb and gutter, pavement and sidewalk on Carroll Lane which bounds the above described dedicated park, the construction to be contracted for and financed by Developer. The improvements will be constructed in accordance with the plans and specifications approved by the Department of Engineering & Physical Development, October 6, 1975. This agreement shall be null and void should the subdivision construction authorized by the approved plans and specifications not be carried out within the time limits specified in City's Platting Ordinance. 2. City agrees to reimburse Developer, upon satisfactory completion of the aforesaid improvements, its pro rata share of the construction costs, plus engineering, estimated to be Two Thousand Eight Hundred and 04/100 dollars ($2,800.04), as shown on the attached construction cost estimate and map, attached hereto and made a part hereof, marked Exhibit "A ". Reimbursement will be based on verified construction costs. 3. Developer agrees to indemnify City against any and all claims arising out of the construction of the aforesaid improvements. s fxu -A° 1976.
