HomeMy WebLinkAbout13306 ORD - 07/28/1976jkh:7- 28 -76; 1st AN ORDINANCE ` AMENDING ORDINANCE NO. 8127, AS AMENDED, BY AMENDING SECTTON 1, SUBSECTION b BY SUBSTITUTING NEW SALARY SCHEDULES, EFFECTIVE AUGUST 2, 1976; AMENDING SECTION 1, SUBSECTION (b) BY DELETING FROM THE FIRE AND POLICE SALARY SCHEDULE THE FIRST ASSISTANT FIRE CHIEF AND ASSISTANT. , FIRE CHIEF UNDER THE FIRE CLASSIFICATIONS; AMENDING SECTION 1, SUBSECTION (e) BY ESTABLISHING WITHIN THE ADMINISTRATIVE, EXECUTIVE, PROFESSIONAL AND LABORERS SERIES THE CLASSIFICATIONS OF FIRST ASSISTANT FIRE CHIEF, AT CLASS GRADE 34, AND ASSISTANT FIRE CHIEF, AT CLASS GRADE 32; AMENDING SECTION 2, SUBSECTION (b), PARAGRAPH (9) SO AS TO PROVIDE FOR ADVANCEMENT BEYOND THE "D" STEP FOR POSITIONS OF CHIEF OF FIRE, CHIEF OF POLICE, ASSISTANT POLICE CHIEF, POLICE COMMANDER, FIRST ASSISTANT FIRE CHIEF AND ASSISTANT FIRE CHIEF; AMENDING SECTION 5, SUBSECTION (b), BY INCREASING THE MONTHLY EDUCATIONAL INCENTIVE PAY FOR FIRE AND POLICE SERIES; AMENDING SECTION 5, SUBSECTION (b), PARAGRAPH 2 TO PROVIDE ADDITIONAL PROVISION CONCERNING FIRE AND POLICE SERIES; AMENDING SECTION 7, SUBSECTION (b),TO ` EXCLUDE FROM OVERTIME COMPENSATION THE POSITIONS OF ASSISTANT POLICE CHIEFS AND POLICE COMMANDERS, AND TO PROVIDE FOR COMPENSATORY TIME OFF AT THE DISCRETION OF THE DEPARTMENT HEAD WITHOUT THE RESTRICTION THAT SUCH COMPENSATORY TIME BE ONLY WITHIN THE WEEK THAT THE ADDITIONAL HOURS WERE WORKED; AMENDING SECTION 7, SUBSECTION (c), SO AS TO PROVIDE FOR ACCRUAL FOR TIME OFF PURPOSES FOR EMPLOYEES IN THE POLICE SERIES AND PAYMENT.THEREFOR AT TIME OF SEPARATION; AMENDING SECTION 9, SUBSECTION "(a), AS TO PROVIDE FOR ONE ADDITIONAL HOLIDAY FOR ALL CITY OFFICERS AND EMPLOYEES; AMENDING SECTION 9, SUBSECTION . (c), SO AS TO PROVIDE FOR COMPENSATION FOR EMPLOYEES WORKING A ROTATING OR VARIATION OF ROTATING SHIFT WORK; AMENDING SECTION 10, SUBSECTION (c), BY DELETING THE PRESENT SENTENCE ONE AND IN LIEU THEREOF ADDING THE PROVISIONS THAT EMPLOYEES IN THE FIRE AND POLICE SERIES SHALL NOT BE CHARGED FOR SICK LEAVE FOR INJURIES SUSTAINED IN THE LINE OF DUTY AND MAKING PROVISION FOR PAYMENT OF DISABILITY LEAVE; AMENDING SECTION 10 BY ADDING SUBSECTION (h) SO AS TO PROVIDE FOR ADMINISTRATIVE LEAVE FOR ASSISTANT CHIEFS AND COMMANDERS IN THE POLICE DEPARTMENT; PROVIDING A SEVERANCE CLAUSE; PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY. ' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 8127, as amended, Adopting and Providing for the Administration'of the Compensation Plan, be amended by amending Section 1, Subsection (b), by substituting new Salary - Schedules, attached hereto as Exhibits "A ", "B ", "C ", and "D ",'to become effective August 12, 1976; provided, however; that those employees whose salaries would have been changed ortransitioned "after June 7, 1976; by the terms of Section 2 of Ordinance No. 13180 shall continue to be paid at the rate shown in Section 2,of said Ordinance No. 13180, with an increase of 6.2 %,' A'. MICROFILMED 13306 JUN 16 13bu until the date on which their salaries would have been changed by the terms of said-Ordinance No. 13180, on which date they shall commence earning wages at the rate shown on the schedule attached hereto as Exhibit "B ". SECTION 2. That Section 1, Subsection (bI be amended by deleting from the Fire and Police Salary Schedule the following fire classifications: \ Class Code Class Title 907 First Assistant Fire Chief 908 Assistant Fire Chief SECTION 3. That Section 1, Subsection (e), be amended by adding to the Administrative, Executive, Professional and Laborers Series, the following classifications: Class Code Class Title Class Grade 907 First Assistant Fire Chief 34 908 Assistant Fire Chief 32 SECTION 4. That Section 2, Subsection (b), paragraph (9), be amended to hereafter read as follows: "Notwithstanding any other section of this ordinance, advancement beyond the 'D' step for the positions of Chief of Fire, Chief of Police, Assistant Police Chief, Police Commander, First Assistant Fire Chief', and Assistant Fire Chief, shall be only according to the provisions of Section 2, Subsection (b), paragraph (6)." SECTION 5. That Section 5, Subsection (b), paragraph (1), be amended to hereafter read as follows: "(1) Employees shall be eligible for educational incentive pay at the monthly rate of $0.60 per month for each academic semester hour satisfactorily completed, provided that such hours are applicable toward a degree in Police Science when employed in the Police Division or in Fire Science when employed in the Fire Division. Approved hours must include the core curriculum in Law Enforcement or other similarly required curri- culum in Fire Science. In no event will more than $42.60 per month be paid without successful completion of the requirements and the receipt of the Associate of Applied Science Degree, Police Science, or Fire Science, -2- as applicable. If the employee is attending a four -year college, he may meet this requirement by filing a copy of his certified degree plan with the Director of Personnel, noting his expressed intent to obtain a Bachelor's Degree in Police Science or Fire Science. All approved hours above the Associate Degree in Fire or Police Science will be eligible for educational pay at this rate up to an additional $29.40 per month or a combined total of $72. Successful completion of the requirements and receipt of a Bachelor's Degree in Police Science or Fire Science will qualify the employee for a maximum of $75 per month." SECTION 6. That Section 5, Subsection (b), paragraph (2), be amended to hereafter read as follows: "(2) Approved hours above the Bachelor's Degree applicable toward a Master's Degree in Police Science or Fire Science will be eligible for educational incentive pay at the same rate up to an additional $12 per month. Successful completion of•the Master's Degree in Police or Fire Science will qualify the employee for an additional $6 per month for a maximum combined total of an additional $18 on a Master's Degree." SECTION 7. That Section 7, Subsection (b), be amended to here- after read as follows: "(b) Overtime Compensation. All full -time employees in positions of classes in Grade 22 and below, Equipment Operator IV's, Engineering Design personnel, Senior Radio Technicians, and all positions in'the Police and Fire Series except Police and Fire Chiefs, Assistant Police Chiefs, and Police Commanders, shall be paid for authorized overtime work at the rate of one and one -half times the regular rate, provided that such rate for positions in the Fire Series with scheduled work weeks other than 40 hours shall be computed on the basis of 173.33 hours per month. Compensatory time off equal to the actual hours of overtime may be granted and scheduled at the discretion of the department head concerned. Employees within the Police Series may elect, with the concurrence of the department head, to be granted compensatory time off at the rate of one and one -half times the actual hours of overtime worked in lieu of overtime cash payment. Other salaried officers and employees in positions of Grade 23, or above, excluding Equipment Operator IV's and engineering design personnel, shall not be -3- eligible for regular overtime compensation as provided above, but may be granted compensatory time off in unusual cases when authorized by the City Manager; except upon authorization of the City Manager, overtime may be paid on a straight time basis for work performed under contracts with the Federal Government of civil defense purposes." SECTION 8. That Section 7, Subsection (c), be amended by adding the following sentence: "Accrual for time off purposes for employees in the Police Series may be accrued on an unlimited basis with payment of accrued compensatory time in the event of separation in good standing of such employee, not to exceed thirty (30) days at the employee's regular rate of pay." SECTION 9. That Section 9, Subsection (a), be amended by adding the following sentence to the list of holidays: "One holiday to be determined by the City. ". SECTION 10. That Section 9, Subsection (c), be amended by amending the second sentence to hereafter read as follows: "Monthly salaried employees in positions of Grade 22 or below with the exception of employees working a rotating or variation of rotating shift work shall be compensated in addition to their regular rate of pay for time worked on a holiday,one and one -half times the regular rate of pay, or, at the discretion of the division head, such employee may be granted equal time off at such time as the division head may designate, for required work.on a holiday and be paid, in addition to such time off, one -half times the regular rate of pay." and by adding the followfng sentence: "Employees working a rotating or variation of rotating shift work shall be granted in addition to their regular rate of pay for time worked on a holiday equal time off as the head of the division may designate, and be paid in addition to such time off, one -half times the regular rate of pay." SECTION 11. That Section 10, Subsection (c), be amended by deleting the sentence reading, "Firemen and Policemen will be paid according to State law for injuries occurring while in the course of employment." In lieu thereof, add the following sentences: -4- "No sick leave shall be charged for injuries sustained in the line of duty for employees in the Fire and Police Series. Employees shall be paid disability leave in an amount not to exceed their regular salary as provided by State law for injuries occurring while in the course of employ- ment." SECTION 12. That Section 10 be amended by adding a new subsection, to be numbered (h), reading as follows: "(h) Administrative Leave: Assistant Chiefs and Commanders in the Police Department may receive administrative leave time for work per- formed in excess of their regularly scheduled duties. Said leave time may be granted at the discretion of the Chief subject to scheduling and manpower contingencies that may arise. Said administrative leave time shall, in no event, exceed that amount of time that Assistant Chiefs and Commanders have accumulated in excess of their regularly scheduled work." SECTION 13. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, word, phrase, or provision hereof be given full force and effect for its purpose.. SECTION 14. Except as otherwise provided herein, the effective dates of the above changes shall be August 2, 1976. SECTION 15. The fact that there is a need to maintain at all times an efficient administration of City-affairs creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings.of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and -5- after its passage, IT IS ACCORDINGLY SO ORDAINED, this the e) . of July, 1976.
