HomeMy WebLinkAbout13307 ORD - 07/28/1976JKH:vp:7 /28/76:lst TEXAS: AN ORDINANCE AMENDING THE COASTAL BEND MANPOWER CONSORTIUM AGREEMENT; AUTHORIZED BY ORDINANCE NO. 13099, PASSED AND APPROVED BY THE CITY COUNCIL ON MARCH 24, 1976, BY AMENDING SECTION 6, PARAGRAPH 2, SO AS TO PROHIBIT MEMBERSHIP ON THE MANPOWER PLANNING ADVISORY COUNCIL OF EMPLOYEES AND MEMBERS OF THE GOVERNING BODIES OF AGENCIES CONTRACTING FOR DELIVERY OF CETA SERVICES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the Coastal Bend Manpower Consortium Agreement, authorized by Ordinance No. 13099, passed and approved by the City Council "y on March 24, 1976, be and the same is hereby amended by amending Section 6, paragraph 2, so as to add the following: "and no employee or member of the governing body of any agency contracting for delivery of CETA services" following the words "salary from any CETA assisted program" and before the words "shall be appointed to the Planning Advisory Council" in line seven of said paragraph 2 of Section 6, said sentence to hereafter read: "No person receiving any part of his salary from any CETA assisted program and no employee or member of the governing body of any agency contracting for delivery of CETA services shall be appointed to the Planning Advisory Council." SECTION 2. Except as herein and hereby amended, the terms, conditions and provisions set forth in the agreement authorized by Ordinance No. 13099 shall remain in full force and effect. SECTION 3.• The necessity to amend the Coastal Bend Manpower Consortium Agreement as aforesaid at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of;•the Charter rule and that this ordinance be passed finally on the date'of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this MICROFILMED JUR 161980 M 13307 O the _day of July, 1976. BRUCE AYCOCK, City Attorney By YYIIvW- ssistant city 7fttorney M YOR THE CITY OF CORPUS CHRISTI, MR 0 0 THE STATE OF TEXAS COUNTY OF NUECES WHEREAS, the City of Corpus Christi and various units of local government within the Texas State Planning Region No. 20 have previously formed the Coastal Bend Manpower Consortium; and WHEREAS, under date of May 4, 1976, the said various units of local government, including the City of Corpus Christi, executed a Contract for Manpower Program for a term of twelve months, commencing October 1, 1976, continuing through September 30, 1977; and WHEREAS, the units of government which are parties signatory to the aforesaid contract desire to amend the said contract: NOW, THEREFORE, the City of Corpus Christi and the counties com- prising the Texas State Planning Region No. 20, known as the Coastal Bend Area, do agree to the following amendment to the contract of May 4, 1976: That the second paragraph of Section 6 shall hereafter read as follows: "Each participating unit of local government shall, to the extent practical, include as nominees to the Planning Advisory Council members who are representative of the client community, community based organizations, the employment service, education and training agencies and institutions, business, labor, and where appropriate, agriculture. Persons representative of other interested groups may also be nominated. No person receiving any part of his salary from any CETA assisted program and no employee or member of the governing body of any agency contracting for delivery of CETA services shall be appointed to the Planning Advisory Council. A person serving on the Planning Advisory Council shall not serve on the Consortium Executive Committee. Any member of the Planning Advisory Council who fails to attend three consecutive meetings shall be deemed to have resigned and the governing body of the appointing agency will be asked to appoint a permanent replacement. Professional, clerical, and technical staff to serve the Planning Advisory Council will be provided by the administrative unit. Funds for such support- ive services will be made available from the prime sponsor's basic grant allocation. Final decisions with respect to recommendations of the Planning Advisory Council will be made by the Executive Committee." 0 Except as herein and hereby provided and agreed, the terms, con- ditions and provisions of the Contract for Manpower Program dated May 4, 1976, shall be and remain in full force and effect.
