HomeMy WebLinkAbout13315 ORD - 08/04/1976EE.vp•e /3/76 1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE 19]5 -1976 COASTAL BEND MANPOWER CONSORTIUM AGREEMENT BY AMENDING THE SECOND PARAGRAPH OF SECTION 6, SO AS TO PROHIBIT MEMBERSHIP ON THE MANPOWER PLANNING ADVISORY COUNCIL OF EMPLOYEES AND MEMBERS OF THE GOVERNING BODIES OF AGENCIES CONTRACTING FOR DELIVERY OF BETA SERVICES, ALL AS IS SET FORTH IN AN AMENDMENT TO THE AGREEMENT, A COPY OF WHICH, IN SUBSTANTIALLY THE FORM ATTACHED HERETO, MARKED EXHIBIT "A ", IS MADE A PART HEREOF, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS SECTION 1. That the City Manager be and he hereby is authorized to execute an amendment to the 1975 -1976 Coastal Bend Manpower Consortium Agreement, originally a,thorimd by Ordinance 12504, so as to prohibit mem- bership on the Manpower Planning Advisory Council of employees and members of the governing bodies of agencies contracting for delivery of CETA services, all as is more fully set out in an amendment to the agreement, a copy of which, in substantially the form attached hereto, marked Exhibit "A ", is made a part hereof for all pertinent purposes SECTION 2 The necess rty to suthor— execution of the aforemen- tioned amendment to the Manpower Consortium Agreement at 'the earliest passible time creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or solution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effec�� t /Z. and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of August, 19 ]6 A�TTTEEESSTT- Ciry THE CITY OF CORPUS CHRISTI, 111AI APPROVE DAY OF AUGUST, 19]6 MICROFILMEQ J. BRUCE AYCOCK, City Attorney JUN 171990 By ss ttant ty ttornev V 13315 EE vp 813/76:1st THE STATE OF TEXAS J COUNTY OF NUECES WHEREAS, the City of Carpus Christi and various units of local government within Texas State Planning Region No 20 have previously formed the Coastal Bend Manpower Consortium, and WHEREAS, under date of March 6, 1975, the said various units of local government, including the City of Carpus Christ,, executed a Contract for Manpower Program for a term of twelve months, commencing July 1, 1975, and continuing through June 30, 1976, the term of which was extended through September 30, 1976, by Ordinance No 13099, and WHEREAS, the units of government which are parties signatory to the aforesaid agreement desire to amend the said agreement: NOW, THEREFORE, the City of Corpus Christi and the counties com- prising Texas State Planning Region No. 20, known as the Coastal Bend Area, do agree to the fallowing amendment to the anginal contract of Parch 6, 1975. That the second paragraph of Section 6 shall hereafter read as follows: "Each participating unit of local government shall, to the extent practical, include as norm nees to the Planning Advisory Council members who are representative of the client community, community based organizations, the employment service, education and training agencies and institutions, business, labor, and where appropriate, agriculture. Persons representative of other interested groups may also be nominated. No person receiving any part of his salary from any CETA assisted program and no employee or member of the governing body of any agency contracting for delivery of CETA services shall be appointed to the Planning Advisory Council. A person serving on the Planning Advisory Council shall not serve on the Consortium Executive Committee. Any member of the Planning Advisory Council who fails to attend three can - secut,ve meetings shall be deemed to have resigned and the governing body of the appointing agency will be asked to appoint a permanent replacement Profess ionai, clerical, and technical staff to serve the Planning Advisory Council will be provided by the administrative unit. Funds for such supportive services will be made available from the Prime sponsor's basic grant alloca- tion. Final d —sions with respect to reconmendatlons of the Planning Advisory Council will be made by the Executive Committee." Except ac herein and hereby provided and agreed, the terms, conditions and provisions of the Contract for Manpower Program dated March 6, 1975, as amended and extended, shall be and remain in full force and effect.
