HomeMy WebLinkAbout13341 ORD - 08/11/1976EE:vmr:8- 9- 76;lst AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF AGNES A. VICK BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A PORTION OF THE 82 -ACRE TOM WHELAND TRACT SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "I -2" LIGHT INDUSTRIAL DISTRICT TO "R -IB" ONE - FAMILY DWELLING DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Agnes A. Vick for amendment to the .zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday , August 11, 1976 at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the Zoning on the following described portion of the 82 -acre Tom Whelan Tract, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "I -2" Light Industrial District to "R -1B" One - Family Dwelling District, and described as follows: Being a tract of land containing 0.315 acre, more or less, out of the Tom Whelan 82 acre tract described in Deed recorded in Volume P, Page 416 of the Deed Records of Nueces County, Texas, and also being the North one half of a tract of land containing 0.63 acre described in Deed from Ellen Timon Kelly to E. V. Dupree dated December 19, 1945 and filed for record in the office of the County Clerk of Nueces County, Texas on December 29, 1945 at 10:36 o'clock A.M., and being more completely described by metes and bounds as follows, to -wit: Beginning at the Northwest corner of said E. V. Dupree 0.63 acre tract, as marked by a 1 inch iron pipe, for the NW corner of this tract and the point of beginning; THENCE N 82° -57' E, along the northerly line of said E. V. Dupree 0.63 acre tract, a distance of 185.0 feet to a point marked by a 5/8 inch iron rod for the NE corner of this tract, also being the NE corner of said E. V. Dupree 0.63 acre tract; THENCE S 07° -03' E, along the westerly line of the 0. N. Stevens tract, a distance of 75.00 feet to a point marked by a 5/8 inch iron rod for the SE corner of this tract; THENCE S 82° -57' W a distance of 185.0 feet to a point marked by a 5/8 inch iron rod set in the easterly line of Navigation.Blvd. -' (formerly Wheland Drive) for the SW corner of this tract; THENCE N 07° -03' W, along the easterly line of Navigation Blvd. and along the easterly line of said E. V. Dupree 0.63 aEre tract, a distance of 75.00 feet to the point of beginning and containing 0.315 acre of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect�,y1�" from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this they day of ATTEST: Ci y Secretary MAYOR THE CITY OF CORPUS CHRISTI, TEXAS AP VED.
