HomeMy WebLinkAbout13349 ORD - 08/18/1976jkh:8- 17 -76; 1st AN ORDINANCE AMENDING ORDINANCE NO. 12929, PASSED AND APPROVED BY THE CITY COUNCIL ON DECEMBER 17, 1975, SO AS TO EXTEND THE PERIOD OF TIME FOR CLOSING TO VEHICULAR TRAFFIC OF THE 1200 THROUGH 1700 BLOCKS OF NORTH SHORELINE BLVD. FOR BAYFEST '76 FROM 7:00 A.M., SATURDAY, SEPTEMBER 25, 1976 TO 4:00 P.M., TUESDAY, OCTOBER 5, 1976; AUTHORIZING THE CITY MANAGER TO EXECUTE THE ATTACHED APPLICATION PERMIT; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Junior League of Corpus Christi, Texas,and the Corpus Christi Arts Council have formulated plans for the Bayfest '76 for the pur- pose of celebrating the nation's Bicentennial to be held on Friday, October 1, 1976,through Sunday, October 3, 1976; and WHEREAS, the City Council has previously approved the closing to vehicular traffic of the 1200 through 1700 blocks of North Shoreline Blvd. from 10:00 A.M., Wednesday, September 29, 1976, to 12:00 noon, Monday, October 4, 1976, for the purpose of preparing for and conducting of said Bayfest '76; and WHEREAS, in order to better accommodate participation by numerous civic and community groups in the sponsorship of festival -type booths and entertaining programs for the purpose of celebrating the Bicentennial, it is deemed advisable to extend the period of time for closing of the afore- said streets in order to assemble and disassemble displays and booths: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 12929, passed and approved by the City Council on December 17, 1975, be and the same is hereby amended by amending Sections 1 and 4 thereof so as to extend the period of time for closing to vehicular traffic of the 1200 through 1700 blocks of North Shoreline Blvd. from 7:00 A.M., Saturday, September 25, 1976, to 4:00 P.M., Tuesday, October 5, 1976. SECTION 2. That the City Manager is authorized to execute the attached application /permit for and on behalf of the City, which shall be filed for record in the office of the City Secretary. MICROFILMED'/ JUN 190A 48 Gy SECTION 3. Except as herein and hereby amended, the provisions of Ordinance No. 12929 shall be and remain in full force and effect. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid s or unconstitutional by final judgment of a court of competent jurisdiction C it shall not affect any other section, paragraph, subdivision, clause, phrase, word,or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase; word, or provision hereof be given full force and effect for its purpose. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. SECTION 6. The necessity to amend Ordinance No. 12929 as herein- above set forth and for the purposes outlined creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage and publication, IT IS ACCORDINGLY SO , ORDAINED, this the_&4day of August, 1976. BRUCCEAAY�COC.K,, CITY ATTORNEY By ,�^ Assistant City AttornLsy MAYOR Pro -lem THE CITY OF CORPUS CHRISTI, TEXAS APPLICATION /PERMIT THE STATE OF TEXAS d KNOW ALL MEN BY THESE PRESENTS: COUNTY OF NUECES I Application The Junior League of Corpus Christi, Texas, and the Corpus Christi Arts Council, in order to sponsor the Bayfest '76 on October 1, 2 and 3, 1976, hereby make application, acting by and through Mrs. Susan Kennedy and Mrs. Glenda Kane, Bayfest '76 Co- Chairwomen representing The Junior League of Corpus Christi, Texas, and the Corpus Christi Arts Council, respectively, to the City of Corpus Christi, acting by and through R. Marvin Townsend, its duly authorized representative,for the closing to vehicular traffic of the 1200 through 1700 blocks of North Shoreline Blvd., from 7:00 A.M., Saturday, September 25, 1976, to 4:00 P.M., Tuesday, October 5, 1976. In consideration of the closing of said street, the sponsoring organizations hereby agree: 1. To allow emergency vehicles to use such areas as may be required in said area. 2. To furnish liability insurance in the amounts of at least $100,000/$300,000 /$50,000, a Certificate of which is attached hereto. 3. To restore any damaged City property promptly after the close of the Bayfest. Such restoration liability shall not exceed $500. 4. To obtain the approval of the Director of Engineering & Physical Development for any work which requires holes or other changes in the pave- ment, curb, or sidewalk. 5. To obtain the approval of the Director of Community Enrichment to use the Marina and Barge Dock. 6. To obtain the appropriate beer and food permits. 7. To construct all displays in accordance with the appropriate City Codes, and furnish adequate portable restrooms. 8. To provide certain detour signs and not less than one uni- formed security guard. 9. To not obliterate or deface any pavement markings heretofore existing for the guidance of motor vehicles. 10. To clean the area and restore it for use for vehicular traffic after the close of the Bayfest. Sponsors agree to pay the City half the cost of the City crew cleanup, i.e., hosing down, push - brooming sidewalks and streets, and running street sweeper, not to exceed $50, with the under- standing that there will be no such cleanup charge if the sponsors have removed all loose debris from the permit area. To allow the use of the street, medians, seawall, Marina and Barge Dock for the activities of the Bayfest. 3. To allow the sale of beer, food and the various Bayfest activities. 4.
