AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH
COLEMAN BROTHERS PROPERTIES FOR THE PURPOSE OF HOUSING
IN THE OLD SEARS GARDEN SHOP CERTAIN MEDICAL SUPPLIES
BY THE CITY IN CONNECTION WITH THE IMPLEMENTATION OF THE
INOCULATION PROGRAMS FOR VICTORIA AND NEW JERSEY (SWINE)
FLU, ALL AS MORE FULLY SET OUT IN THE CONTRACT, A SUB-
STANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART
HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY.
WHEREAS, the City has been authorized to proceed with mass influenza
vaccine inoculation programs for Victoria and New Jersey.,(swine) flu; and
WHEREAS, the initial program will begin early in September to
vaccinate all high risk persons, including those over 65 years of age; and
WHEREAS, the City needs and desires facilities to house certain
medical supplies in connection with the implementation of the inoculation
program:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager be, and he is hereby authorized
to execute a contract with Coleman Brothers Properties for the purpose of
housing in the old Sears garden shop certain medical supplies by the City
in connection with the implementation of the inoculation programs, all as
more fully set out in the contract, a substantial copy of which is attached
hereto and made a part hereof, marked Exhibit "A ".
SECTION 2. The necessity to authorize execution of the aforesaid
contract in order that the City may implement the swine influenza inoculation
program at the earliest practicable date creates a public emergency and
an imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction but that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared such
emergency and necessity to exist, and having requested the suspension of
the Charter rule and that this ordinance be passed finally on the date of
its introduction and take effect and be in full force and effect from and

CONTRACT
THE STATE OF TEXAS
COUNTY OF NUECES
This contract, by and between Coleman Brothers Properties, herein-
after referred to as "Coleman ", and the City of Corpus Christi, Texas, a
municipal corporation, duly organized under the laws of the State of Texas,
hereinafter referred tq as "City ".
WITNESSETH:
WHEREAS, the City has been authorized to proceed with mass influenza
vaccine inoculation programs for Victoria and New Jersey (swine) flu; and
WHEREAS, the initial program will begin early in September to
vaccinate all high risk persons, including those over 65 years of age; and
WHEREAS, the City needs and desires facilities to house certain
medical supplies in connection with the implementation of the inoculation
program:
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that City and
Coleman do enter into the following agreement:
I
The City hereby agrees to lease and Coleman hereby agrees to lease
to the City, in accordance with the terms and provisions hereinafter set out,
the following described property:
The old Sears garden shop located at-1301 Leopard,
directly behind the existing Health Department
Building. A map of this location is attached
hereto and incorporated herein, referred to as
Exhibit "A ".
II
The term of this lease shall be for three months, beginning September
1, 1976, and ending November 30, 1976. The total rental for this term will
be One Hundred Fifty Dollars ($150), payable in Fifty Dollar ($50) monthly
installments no later than the 10th of each month.
III
The City shall have an option to renew this lease for an additional
three -month period at the same rental rate. Said option shall be exercised
by letter from the City Manager or his designated representative, to the
address of the Lessor (indicated below) at least five days prior to the
expiration of the initial term.
IV

V
The facility shall be used for the storage of acetone, alcohol,
cotton balls, bandaids, printed forms, and other items necessary to the
implementation of the inoculation program.
VI
Coleman agrees that none of its agents shall be considered as
employees of City and City shall not be liable in any way for any injuries
sustained to the person of these agents.
VII
City agrees to indemnify and hold harmless Coleman from any liability
and /or claims arising out of the execution of this contract.
EXECUTED IN DUPLICATE, each of which shall be considered an original,
this day of 1976.
