HomeMy WebLinkAbout13364 ORD - 08/25/1976y` MLM:vp:8- 24- 76:lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH FEIST & FEIST, MANAGING AGENTS FOR DOLLAR LAND CORPORA- TION, LTD. (U.S.) FOR THE PURPOSE OF USE OF STORE #41, LOCATED IN THE PARKDALE PLAZA SHOPPING CENTER, AS A CLINIC SITE FOR IMPLEMENTATION OF THE SWINE INFLUENZA INOCULATION PROGRAM BY THE CITY, WITH NO RENTAL BEING CHARGED BY PARKDALE PLAZA FOR THE USE OF THIS SITE, ALL AS MORE FULLY SET OUT IN THE CONTRACT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. WHEREAS, the City has been authorized to proceed with mass influenza vaccine inoculation programs for Victoria and New Jersey (swine) influenza; and WHEREAS, the initial program will begin in September to vaccinate " all high risk persons, including those 65 years of age and over; and WHEREAS, the City, being desirous of quick implementation of this program, needs a clinic site to help effectuate this inoculation program: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a contract with Feist & Feist, Managing Agents for Dollar Land Corporation, Ltd. (U.S.) for the purpose of use of store #41, located in the Parkdale Plaza Shopping Center, as a clinic site for implementation of the swine influenza inoculation program by the City, with no rental being charged by Parkdale Plaza for the use of this site, all as more fully set out in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. The necessity to authorize execution of the aforesaid contract in order that the City may implement the swine influenza inoculation program at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of MICROFILwItu JUN 17 19-6u IL3364 its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the,.26- ay of August, 1976. (U.S.), hereinafter referred to as "Parkdale Plaza ", and the City of Corpus Christi, Texas, a municipal corporation, duly organized under the laws of the State of Texas, hereinafter referred to as "City ", t W I T N E S S E T H : WHEREAS, the City has been authorized to proceed with mass influenza vaccine inoculation programs for Victoria and New Jersey (swine) influenza; and WHEREAS, the initial program will begin in September to vaccinate all high risk persons, including those 65 years of age and over; and WHEREAS, the City, being desirous of quick implementation of this program, needs a clinic site to help effectuate this inoculation program: NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that City and Parkdale Plaza do enter into the following agreement: I Parkdale Plaza hereby agrees to allow the use of store #41, located in the Parkdale Plaza Shopping Center, as a clinic site for implementation of the swine influenza inoculation program by the City. No rental shall be charged by Parkdale Plaza for the use of this site. II This site will be used beginning September 15 through October 15, 1976. Its primary use will be inoculation of persons 65 years of age or over. III In the event the inoculation vaccine does not arrive as scheduled, different time arrangements may be worked out by agreement of Parkdale Plaza and the City. I IV The City agrees to indemnify and hold harmless Parkdale Plaza from any liability and /or claims arising out of the execution of this contract.
