HomeMy WebLinkAbout13371 ORD - 09/01/1976MLM:jkh:8- 31 -76; 1st TEXAS: AN ORDINANCE AMENDING ORDINANCE NO. 13325, PASSED AND APPROVED ON' AUGUST 4, 1976, BY CHANGING THE AMOUNTS APPROPRIATED BY SAID ORDINANCE; AUTHORIZING THE EXECUTION OF A CHANGE ORDER FOR $5,000 TO COVER INCREASED COST TO CONTRACTOR SINCE APRIL 14, 1976; SAID ORDINANCE TO TO AMENDED AS FOLLOWS: AUTHORIZING THE CITY MANAGER, SUBJECT TO THE EXECUTION OF AN AGREEMENT OF COOPERATION WITH THE WEST OSO INDE- PENDENT SCHOOL DISTRICT AND PAYMENT OF $15,000 TO THE CITY BY THE SCHOOL DISTRICT AS STIPULATED IN THE AGREEMENT, TO EXECUTE A CONTRACT WITH ASPHALT PAVING AND CONSTRUCTION COMPANY FOR CONSTRUCTION OF THE WEST OSO TENNIS COURT IMPROVEMENTS; AUTHORIZING THE EXECUTION OF CHANGE ORDER NO. 1 FOR COST INCREASES SINCE BIDS RECEIVED; APPROPRIATING $66,000, OF WHICH $59,770 IS FOR THE CONSTRUCTION CONTRACT, $5,000 IS FOR CHANGE ORDER NO. 1, AND $1,230 IS FOR TESTING AND INCIDENTAL AND RELATED EXPENSES, SAID APPROPRI- ATION OF $66,000 TO BE OUT OF THE NO. 291 PARK BOND FUND FOR PROJECT NO. 291- 72 -5.7, WITH THE SUM OF $15,000 TO BE REIMBURSED BY THE WEST OSO INDEPENDENT SCHOOL DISTRICT TO THE NO. 291 PARK BOND FUND; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That Ordinance No. 13325, passed and approved by the City Council on August 4, 1976, be and the same is hereby amended so as to change the amounts appropriated by said ordinance and to authorize a Change Order in the amount of $5,000 to cover increased costs to the contractor since bids were received on April 4, 1976, as more fully set out hereinbelow: "Authorizing the City Manager, subject to,the execution of an agreement with the West Oso Independent School District and payment of $15,000 by the School District to the City as stipulated in the agreement, to execute a contract with Asphalt Paving and Construction Company for construction of the West Oso Tennis Court Improvements, all as is more fully described in the plans and specifications and contract documents on file in the office of the City Secretary, all of which are made a part hereof by reference and according to the bid of Asphalt Paving and Construc- tion Company, opened on the 14th day of April, 1976, the said bid being the most advantageous to the City of Corpus Christi. - "That authorization is hereby given for execution of Change Order No. 1 in the amount of $5,000 for cost increases since bids were received. M00FILMED, JUN 301980 "Appropriating a total of $66,000, of which $59,770 is for the construction contract, $5,000 is for Change Order No. 1, and $1,230 is for testing and incidental and related expenses. The appropriation of $66,000 is to be out of the No. 291 Park Bond Fund for Project No. 291- 72 -5.7, with the sum of $15,000 to be reimbursed by the West Oso Independent School District to the said No. 291 Park Bond Fund." - SECTION 2. The necessity to execute the aforesaid contract and to appropriate the sums hereinabove set forth at the earliest practicable date in order that construction may proceed without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspen- sion of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the_/4Z day of September, 1976.
