HomeMy WebLinkAbout13373 ORD - 09/01/1976JKH:hb:9 /l /76:lst AN ORDINANCE APPROPRIATING OUT OF THE 220 STREET BOND FUND $3,037 TO SUPPLEMENT FUNDS PREVIOUSLY APPROPRI- ATED BY ORDINANCE N0. 13233 PASSED AND APPROVED BY THE CITY COUNCIL ON JUNE 16, 1976, FOR THE ACQUISITION OF PARCEL NUMBER 1, AIRLINE - PADRE ISLAND DRIVE TO WILLIAMS DRIVE STREET IMPROVE- MENTS PROJECT, 220 -72 -8, BY AWARD OF SPECIAL COMMISSIONERS IN THE AMOUNT OF $7,500 PLUS $600 FOR SPECIAL COMMISSIONERS FEES, APPRAISAL FEES AND COURT COSTS, BEING A MATTER IN CONDEMNATION STYLED CITY OF CORPUS CHRISTI V. TEXAS STAR DISTRIBUTING COMPANY, ET AL, CAUSE NO. 749 -2, COUNTY COURT AT LAW NUMBER 2 OF NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. . BE IT ORDAINED BY THE CITY 'COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby appropriated out of the No. 220 Street Bond Fund $3,037 to supplement funds previously appropriated by Ordinance No. 13233, passed and approved by the City Council on June 16, 1976, for the acquisition of Parcel No. 1, Airline - Padre Island Drive to Williams Drive Street Improvement Project No. 220 -72 -8, by award of Special Commissioners in the sum of $7,500, plus $600 for Special Commissioners' fees, appraisal fees and court costs, being a matter in condemnation, styled City of Corpus Christi v. Texas Star Distributing Company, et al, Cause No. 749 -2, in County Court at Law No. 2 of Nueces County, Texas. SECTION 2. The necessity to provide the sums necessary in order to take possession of the aforesaid parcel in order that the Airline Street Improvement Project may commence without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Chatter rule and that this ordinance take effect and be in full force and effect from and after its 46ssage, IT IS ACCORDINGLY SO ORDAINED this the m day of , 1976.
