AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION - RECORDS, AS AMENDED
FROM TIME TO TII4E AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF
CITY OF CORPUS CHRISTI, BY GRANTING A SPECIAL PERMIT
FOR A BAIT STAND OPERATION, ACCORDING TO THE SITE PLAN
APPROVED BY THE PLANNING COMMISSION, SUBJECT TO THE
CONDITIONS HEREINAFTER SET FORTH ON A PORTION OF NUECES
BAY AND OF BLOCK 415, BROOKLYN ADDITION, SITUATED IN
THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS;
KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING
ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CON-
FLICT HEREWITH; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City
Council its reports and recommendations concerning the application of
City of Corpus Christi for amendment to the
.zoning map of the City of Corpus Christi; and
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before
the City Council of the City of Corpus Christi, in accordance with proper
notice to the public, said public hearing having been held on Wednesday.
September 8, 1976 , at Special Council Meeting of the City
Council in the Council Chamber at City Hall in the City of Corpus Christi;
and
WHEREA.5, by motion duly made, seconded and carried, it was
decided by the City Council that to approve the hereinafter set forth
amendment would best serve public health, necessity and convenience and
the general welfare of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS.
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, passed on the 27th day of August, 1937, appearing of
record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution
Records, as amended from time to time, and in particular as amended by
Ordinance No. 6106, as amended, be and the same is hereby amended by
making the change hereinafter set out. MICROFILMED

SECTION 2. That a Special Council Permit be granted on a portion
of Nueces Bay and of Block 415, Brooklyn Addition, situated in the City of
Corpus Christi, Nueces County, Texas, according to the site plan, approved by
the Planning Commission, for a bait stand operation, all as more fully describ-
ed on the site plan, attached hereto and made a part hereof marked Exhibit "A ";
and subject to all other conditions of "R -1B" One - Family Dwelling District and
"AT" Apartment- Tourist District, more particularly described as follows:
Being a portion Nueces Bay and a portion of Block 415, Brooklyn Addition,
as shown by map of record in Volume R, Page 32, Map Records, Nueces County,
Texas, and more particularly described by metes and bounds as follows:
BEGINNING at a point in the centerline of State Highway No. 181 right -of=-
way, said point being Engineers Station 995 + 01.33 and being -the South
end of the concrete deck of the Nueces Bay Causeway:
THENCE N. 500 23' E. along the centerline of said right- of-way a distance
of 235.83 feet to•a point which is Engineer Station 992 + 64.5;
THENCE N. 39 °•37' W. a distance of 146.08 feet to a point for the Sou`h-
east and beginning corner of the tract of land herein described;
THENCE N. 580 01' 25" W. a distance of 100.0 feet to a point;
THENCE N. 310 58' 35" E., passing the normal shoreline of Nueces Bay at
70.53 feet, in all a- distance of 175.0 feet to a point on the bottom of
said Nueces Bay;
THENCE S. 580 01' 25 '"E.; along the bottom of said Nueces Bay, a distance
of 100.0 feet to a point;
THENCE S.'310 58' --.35" W.-, along the bottom of said Nt:eces Bay, passing
the norrml shoreline-of said bay at 111.20 feet, in all a distance of
-175.0 feet to the place of beginning and containing 17,500 square feet
or 0.401 aces, more or- less. .
Subject to the following conditions:
1. Accessory off - street parking spaces shall be well defined with
header curbs or other physical improvements.
2. No outside storage of material shall be permitted except bait
boxes for live shrimp and bait.,
3. Restrooms shall be located at the west end of the building with
exterior access. A sign shall be installed flat against, or
painted on, the west wall stating "PUBLIC RESTROOMS" in six inch
letters. Small identification signs shall be installed on rest-
room doors. Restrooms shall be properly maintained and open to
the public at no charge at all times. Building drains shall be
connected to the City of Corpus Christi sanitary sewer system.
4. One advertising sign may be installed flat against, or painted on,
the south wall of the building. A sign listing hours of operation
and emergency information may be posted at the main entrance.
One sign providing information to boaters may be installed on the
pier; shall not exceed sixteen square feet in area; and shall be
installed flat against the pier or railing.
5. No signs other than the foregoing shall be permitted outside
of the building. Permitted signs shall not have any moving
or electrical parts.
b. Exterior lighting shall be restricted so that no light shall
be cast in an upward direction and no light shall be cast on
any land or water more than one hundred feet from the lease
area.
7. No sewage, debris, junk, trash, or litter shall be deposited
or allowed to accumulate on the land or in the waters within
or immediately adjacent to the lease area.
8. Exterior material requiring painting shall be painted annually.
9. Plans for construction of any improvements shall be submitted
to the Planning Commission for review and recommendation to the
City Council and no building permit shall be issued until it has
been found that the project will not distract aesthetically from
the approach to the city.
In the event the Board of Adjustment grants any special exception
or variance to the Zoning Ordinance, applicable to the property included in
the Special Permit herein granted, other than the one specified in this Special
Permit, said Special Permit will be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of
Corpus Christi, Texas, approved on the 27th day of August, 1937, as
amended from time to time, except as herein changed, shall remain in full
force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That the necessity of immediately making aforesaid
change for the purpose of maintaining at all-times a comprehensive zoning
ordinance for the City of Corpus Christi creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction and that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared that
such emergency and necessity exist, and having requested the suspension
of the Charter rule and that this ordinance be passed finally on the
date of its introduction and take effect and be in full force and effect

ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
