HomeMy WebLinkAbout13404 ORD - 09/22/1976AN ORDINANCE AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY OF CORPUS CHRISTI TO CONDEMN FEE TITLE TO A CERTAIN PARCEL OR TRACT OF LAND LOCATED IN NUECES COMM, TEXAS; DESCRIBING SAID PROPERTY, IDENTIFYING THE RECORD TITLE OWNERS AND CITING ANY OTHER PARTIES WHO MAY HAVE INTEREST OF RECORD, SAID CONDEMNATION BEING NECESSARY FOR THE ACQUISITION OF PARCEL NO. 1 FOR THE EXPANSION OF INWOOD PARK; DIRECTING THE CITY ATTORNEY TO INSTITOTE CONDEMNATION PROCEEDINGS AGAINST THE RECORD OWNER, CLINTON MANGES, TO CARRY OUT THE INTENTIONS OF THIS ORDINANCE. WHEREAS, it is necessary to acquire, for and on behalf of the City of Corpus Christi a certain parcel or tract of land described as follows: TROJAN DRIVE - PARCEL 1 Being an irregularly shaped tract of land out of Lot 15, Section "D ", Paisleys Subdivision of the Hoffman Tract as shown by map of record in Volume A, Page 28, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at a point which bears N. 61° 33' 30" N., a distance of 55.04 feet and N. 33° 52' 01" E., a distance of 25.12 feet from the Southeast corner of said Lot 15, Section "D ", Paisleys Subdivision of the Hoffman Tract, said point being the intersection of the Northerly right -of -way line of Trojan Drive and the Westerly right -of -way line of State Highway 286 for the most Southerly and beginning corner of the tract of land herein described; Thence N. 61° 33' 30" W., along the Northerly right -of- way line of said Trojan Drive a distance of 211.28 feet to a point which is the most Southerly corner of Block 3, Inwood Village Subdivision, Unit 4, as shown by map of record in Volume 36, Page 104, Map Records, Nueces County, Texas; Thence N. 28° 20' 00" E., along the Easterly boundary line of said Block 3, a distance of 91.27 feet to a point which is the most Westerly corner of a tract of land dedicated for a public park by plat of Inwood Village Unit 3, as recorded in Volume 21, Page 96, Map Records, Nueces County, Texas; Thence S. 61° 40'00" E., along the Southerly boundary line of said public park, a distance of 220.16 feet to a point on the Westerly light -of -way line of the abovementioned State Highway 286;, Thence S. 33° 52' 01" W., along the Westerly right - of -way line of said State Highway 286, a distance of 92.10 feet to the place of beginning and containing 19,690.53, square feet or 0.452 acres more or less. 'JUN 3 -01980 MIURUNILMED& 13404 d WHEREAS, the Inwood Park expansion and other municipal purposes, requires the acquisition of the aforesaid parcel of land; and WHEREAS, record title to the aforesaid parcel appears to be in the following: Clinton Nanges; and WHEREAS, the City of Corpus Christi is unable to arrive at an agreement with the said owner and claimant as to the price and value of said parcel, and damages for the taking thereof by the City; it 3s, therefore, determined by the City Council that it is necessary that said lot or parcel of land described be acquired through the exercise of the City's power of eminent domain for said public purpose: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi, Nueces County, Texas, does hereby order, direct and authorize that eminent domain proceedings be instituted for the purpose of acquiring the aforesaid parcel of land and premises, excluding mineral interests, for use by the City for the expansion of Inwood Park and for other municipal purposes. SECTION 2. That the City Attorney of the City of Corpus Christi is hereby authorized and directed to institute proceedings against the said property, and against all persons who appear to have an interest therein, and to proceed with said condemnation suit to final conclusion and to obtain possession and title to said property for use in the expansion of Inwood Park, and for other municipal purposes.
