AN ORDINANCE AMENDING SECTION 55 -63 OF THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, AS ADOPTED BY ORDINANCE NO. 13328, PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 11, 1976, SO AS TO FURTHER PROVIDE AN EXEMPTION FROM CHARGE FOR SERVICE REQUESTED BY CUSTOMERS FOR LIGHTING AND ADJUSTING OR TURNING OFF ONE OR MORE NATURAL GAS APPLIANCES, AND CONVERSION OF BURNER ORIFICES FOR NATURAL GAS AT RESI- DENTIAL, APARTMENT, OR MOBILE HOME ADDRESSES, FOR THOSE,HEADS OF HOUSEHOLDS 65 YEARS OF AGE OR ABOVE OR THE RECIPIENTS OF SOCIAL SECURITY DISABILITY PAYMENTS; PROVIDING FOR APPLICATION AND APPROVAL OF SUCH EXEMPTIONS BY THE DEPARTMENT OF PUBLIC UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERANCE; PROVIDING AN EFFECTIVE DATE; PRO- VIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 55 -63 of the Code of Ordinances, City of Corpus Christi, 1976 Revision, as adopted by Ordinance No. 13328, passed and approved by the City Council on August 11, 1976, be and the same is hereby amended to hereafter read as follows: "Section 55 -63. Charges for lighting, etc. of natural gas appliances. There shall be a $7.50 charge per appliance service order request for lighting, adjusting, or turning off one or more natural gas appliances, or the conversion of burner orifices to burn natural gas, at a residential, apartment, or mobile home address. Such $7.50 charge includes all gas appliances for which service is requested. All other customers shall be charged $7.50 for each appliance lighted, adjusted, or turned off. Main- tenance of appliances is not included in the lighting and adjusting of any gas appliance except for gas light mantles and glasses, which will be billed to the customer requesting service at retail price over and above the charge set forth above. Provided, however, that in the event the head of a house- hold is 65 years of age or above or the recipient of social security dis- ability payments and resides at a residential, apartment, or mobile home address, then no charge shall be made by the City for such service. Proof of eligibility for the exemptions provided herein shall be on a form to be prescribed by the Director of Public Utilities." 111ICROFILMED JUN 3 01980 13415 SECTION 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION 3. That if for any reason any section, paragraph, subdi- vision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent juris- diction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this,City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. This ordinance shall be effective upon final passage and publication thereof. SECTION 5. Publication shall be made one time in the official pub- lication of the City of Corpus Christi by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. SECTION 6. The necessity to exempt from the aforesaid charges those heads of households 65 years of age or above or the recipient of social security disability payments creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on theldate of its introduction and take effect and be in full force and effe t from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this' the as day of September, 1976.
