HomeMy WebLinkAbout13450 ORD - 10/27/1976JKH:hb:4 /6 /76:lst AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE N0. 6106, AS AMENDED, UPON APPLICATION OF UNITED SAVINGS, BY AMENDING THE ZONING MAP BY CHANGING THE.ZONING ON'TRACT "A" AND TRACT "B" LOCATED'AT THE NORTH END OF CORPUS CHRISTI'BEACH FRONTING APPROX- IMATELY 2360' ALONG THE WEST'SIDE OF'U.'S. HIGHWAY 11181 FORA DEPTH OF APPROXIMATELY 710', AT THE SOUTH APPROACH'OF NUECES BAY CAUSEWAY, APPROXIMATELY '32.89 ACRES OUT OF THE FORMER W. E. POPE`ESTATE, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS FROM "AT" APARTMENT - TOURIST DISTRICT AND 11B -4" GENERAL BUSINESS DISTRICT TO'"B =4" GENERAL'BUSI'NESS 'DISTRICT'AS TO TRACT "A' AND FROM `1AT" APARTMENT- 'TOURIST DISTRICT AND "B-4" GENERAL BUSINESS DISTRICT TO "I -2" LIGHT INDUSTRIAL DISTRICT'AS TO TRACT "B "; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of UNITED SAVINGS for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday March 31, 1976 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and "y, the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amend e y making the change hereinafter set out. 13450 �UN •3 019QA D SECTION 2. That the zoning of Tract "A" and Tract "B" located at the north end of Corpus Christi Beach fronting approximately 2360' along the west side of U. S. Highway #181 for a depth of approximately 710', at the south approach of Nueces Bay Causeway, being approximately 32.89 acres out of the former W. E. Pope Estate, more fully described hereinafter; TRACT "A" Beginning at an iron pipe on the west right -of -way line of U. S. Highway 181 from which point the intersection of the north right -of -way line of Burleson Street and the west right -of -way line of U. S. Highway 181 right - of -way line intersects, marked by a 3/4" iron pin near a flush type con- crete highway marker, bears South 32° 08' west for a distance of 3,460.84'; THENCE North 57° 52' west for a distance of 130' to a point for corner, such point being the southwest corner of this tract; THENCE North 32° 08' east for a distance of 22345.49' to a point on the Nueces County Navigation District #1 north bulkhead line of the Rincon Canal, such point being the northwest corner of this tract; THENCE South 57° 52' east along the Nueces County Navigation District #l, north bulkhead line of the Rincon Canal for a distance of 280' to a point, which point is the intersection of said north bulkhead line and the westerly right -of -way line of U. S. Highway 181 for the northeast corner of this tract; THENCE South 32° 08' west along the west highway right -of -way line of U.S. Highway 181 for a distance of 406.32' to an iron pin which point is the intersection of the north right of way of Hull Street and an angle point in said highway right -of -way line for a corner of this tract; THENCE South 43° 01' 08" -west along the highway right -of -way line for a distance of 794.30' to an iron pin which point is the intersection of the north line of Block 381 and the northeast corner of Lot 12 for a corner of this tract; THENCE South 32° 08' west along the west right of way line of U. S. Highway 181 for a distance of 1,159.16' to the point of beginning, such area con- taining approximately 9.74 acres of land, more or less. TRACT "B" Beginning at a point, such point being north 57° 52' west and 130' from an iron pipe on the west right -of -way line of U.S. Highway 181 from which point the intersection of the north right -of -way line of Burleson Street and the west right -of -way line of U.S. Highway 181 right -of -way line intersects, marked by a 3/4" iron pin, near a flush type concrete marker, bears South 32° 08' west for a distance of 3,460.84'; - THENCE continuing 57° 32' west for a distance of 430' to an iron pipe on the easterly bulkhead line of Canal A for the southwest corner of this tract; THENCE north 32° 08' east along the east bulkhead line of Canal A for a distance of 2,345.49' to a point at the intersection of this line with the Nueces County Navigation District #1 north bulkhead line of the Rincdh Canal for the northwest corner of this tract; -2- t, THENCE south 57 ° 52' east along the Nueces County Navigation District #1 north bulkhead line of the Rincon Canal for a distance of 430' to a point, such point being the northeast corner of this tract; THENCE south 32° 08' west along a line that is 430' from and parallel with the easterly bulkhead line of Canal A, for a distance of 2,345.49' to the point of beginning, such area containing approximately 23.15 acres of land, more or less,, situated in the City of Corpus Christi., Nueces County, Texas, be and the same is hereby changed from "AT" Apartment- Tourist District and "B -4" General Business District to "B -4" General Business District as to Tract "A" and from "AT" Apartment- Tourist District and "B -4" General Business District to "I -2" Light Industrial District as to Tract "B ". SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended £rom' time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and'having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from -3- S.
