HomeMy WebLinkAbout13470 ORD - 11/03/1976JKH: L- 3- 76;lst AN ORDINANCE AMENDING ORDINANCE NO. 13007, PASSED AND APPROVED BY THE CITY COUNCIL ON FEBRUARY 4, 1976 BY AMENDING SECTION 3 OF SAID ORDINANCE SO AS TO CORRECT AND ADJUST THE ASSESSMENTS LEVIED AGAINST ABUTTING PRO- PERTY OWNERS ON THE FOLLOWING STREET: WALDRON FIELD ROAD - FEDERAL AID PROJECT M--R025 (1) METROPOLITAN HIGHWAY 141, FROM PURDUE ROAD TO CARIBBEAN DRIVE; AS HEREINAFTER PROVIDED; KEEPING IN EFFECT ALL OTHER PROVISIONS OF SAID ORDINANCE NO. 13007; PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 13007, passed and approved by the City Council on February 4, 1976, be and the same is hereby amended by amending Section 3 so as to correct and adjust the assessments levied against abutting property owners on the following street: Waldron Field Road - Federal Aid Project M -R025 (1) Metropolitan Highway 141, from Purdue Road to Caribbean Drive, as is reflected on the corrected and adjusted assessment roll, attached hereto and made a part hereof. SECTION 2. That except as herein provided, the terms and condi- tions of Ordinance No. 13007 shall be and remain in full force and effect. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. The necessity to make the adjustments and corrections outlined hereinabove in connection with the paving assessment project creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or reso V, ion shall be read l y, JUN 3 0 1980 at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the A day of , 1976. BRUCE AYCOCK, CITY ATTORNEY BY Assistant Cit3KAttorneyP I a - FINAL WALDRON FIELD ROAD Federal Aid Project M -R025 (1) Metropolitan Highway 141, from Purdue Road to Caribbean Drive This improvement will consist of excavation to a width and depth to permit the construction of pavement, curb and gutter as per State Department of Highways and Public Transportation plans No. 264. The pavement width will vary from 68'6" to 62' back to back of curb, a 9" flex base, 1 -3/4" asphalt stabilized base and 1 -'Z" hot mix asphalt concrete surface. Sidewalks will be 4" reinforced concrete and will vary in width from 4' to 7'6", while all driveways will be 6" reinforced concrete to the property line. The assessment rates for this project to the abutting property owners has been established by calculating the unit prices obtained by the low bid applied to the quantities abutting the property. These rates, based on the present City policy of assessments, are: Curb, Gutter and Pavement $14.25 p.l.f. Sidewalk .75 P.s.f. 6" Reinforced Driveways 15.72 p.s.y. The assessment rate for all property used for residential, churches or schools shall be assessed as: Curb, Gutter and Pavement $ 4.75 p.l.f.
