APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,_ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF LEONARD MARTIN BY GRANTING A SPECIAL COUNCIL PERMIT FOR DEVELOPMENT OF A PERMANENT AMUSEMENT PARK ON A 10.458 ACRE TRACT OF LAND OUT OF LOTS 1 AND 2, SECTION 48, FLOUR BLUFF & ENCINAL FARM AND GARDEN TRACTS, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS MORE PARTICULARLY DESCRIBED ON THE PLAT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A ", SUBJECT TO THE CONDITIONS HEREIN- AFTER SET FORTH; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the,application of Leonard Martin i for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper y notice to the public, said public hearing having been held on Wednesday ember 10, 1478 , at Sasial "Council Meeting of the City Council in the Council Chamber at City Hall in the`City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens' NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by an Ordinance No. 6106, as amended, be and the same is hereby amended bv1nDo r I c making the change hereinafter set out. •�U� ®�V l! l„[ I _J`r4`D /Y 301980 13487 SECTION 2. That a Special Council Permit be granted for develop- ment of a permanent amusement park on a 10.458 acre tract of land out of Lots 1 and 2, Section 48, Flour Bluff and Encinal Farm and Garden Tracts, in the City of Corpus Christi, Nueces County, Texas, more particularly described hereinafter, as more particularly described on the plat, a copy of which is attached hereto and made a part hereof, marked Exhibit "A ", subject to the following conditions: (1) That the standard screening fence be waived along the perimi- ter of the property; and (2) That the parking requirement ratio be one parking space for each four seating'spaces on amusement rides and one parking space for each fifty square feet of game- concession areas plus one parking space for every two employees and subject to all other conditions of "B -4" District: Being a 10.458 acre tract of land out of Lots "I and 2, Section 48, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS SUBDIVISION, Nueces County, Texas, a map of said Subdivision being of record in the Map Records of Nueces County in Volume A, at Pages 41 -43, the subject tract of land hereof being more fully described by Metes and Bounds as follows, to -wit: CO;f*IENCING at the common corners of Section 41, 42, 47 and 48.of Flour Bluff and Encinal Farm and Garden Tracts Subdivision, this point being situated in the Center - line.of the U.S. NAS R.R. right -of -way and is now in the Padre Island Drive right -of -way; THENCE, with the common line of Sections 47 and 48 S.61 degrees E. a distance of 786.32 feet to a point in said section line and in the R -O -W of Padre Island Drive; THENCE, S. 29° W. 215.2' to a 1" galvanized iron pipe set in the South boundary line of Padre Island Drive by. a highway concrete boundary marker; THENCE, S. 29° W. parallel to the S.W. line of Section 48 a distance of 300 feet to a 1" aluminum pipe set for the most,Southern N.E. corner and the BEGINNING place of this survey of 10.458 acre tract of land now being made; THENCE, S. 29° W. 460.50' to a 3/4" galvanized iron pipe set for the S.E. corner of this survey; THENCE, E. 61° W. 686..32' to a -•3/4" galvanized iron pipe set in the N.E. R -O -W line of Flour,Bluff Drive for the S.W. corner of this survey, this point being 100' from the S.W. line of said Section 48 F.B. 5 E.F. & G.T. Subdivision; THENCE, N. 29° E. 657' to a 1" aluminum pipe set:at the intersection of the South boundary line of Padre Island Drive and N.E. line of Flour Bluff Drive, for the N.W. corner of this survey; -2- THENCE, with the South R -O -W line of Padre Island Drive S. 69° 34' E. 592.87' to a 1" aluminum pipe set in said South R -O -W line of Padre Island Drive for the most Northern N.E. corner of this survey; THENCE, S. 29° W. 284.94' to a 1" aluminum pipe set for the Dave Barton tract's S.W. corner and an interior corner of this survey; THENCE, S. 61° E. 100' to the heretofore mentioned 1" aluminum pipe set for the most Southern N.E. corner and the BEGINNING place for this survey now made. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the property included in the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit will be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 7'fIck day of November, 1976.
