HomeMy WebLinkAbout13493 ORD - 11/24/1976JKH:hb:11/24/76 AN ORDINANCE AUTHORIZING CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE LANTANA SPORTS COMPLEX FOR THE USE OF THE SPORTATORIUM LOCATED ON THE PROPERTY OF THE LANTANA SPORTS COMPLEX FOR CITY LEAGUE BASKETBALL GAMES BETWEEN THE MONTHS OF DECEMBER AND FEBRUARY, FOR THE SUM OF $1, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARRED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to enter into an agreement with the Lantana Sports Complex for the use of the Sportatorium located on the property of the Lantana Sports Complex for City league basketball games between the months of December and February, for the sum of $1, all as more fully set forth in the agreement, a sub- stantial copy of which is attached hereto and made a part hereof, marked Exhibit "P. SECTION 2. The necessity to enter into the aforesaid agreement at the earliest practicable date in order to provide a location for the City league basketball games creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from an ter its passage, IT IS ACCORDINGLY SO ORDAINED this the day of 1976. , ATTEST: i ecretary • MAYO THE CITY OF CORPUS CHRISTI, TEXAS AP�VED: . MLM:vp:11-24 -76 THE STATE OF TEXAS COUNTY OF NUECES CONTRACT This contract, by and between the Lantana Sports Complex, here- inafter referred to as "Lantana ", and the City of Corpus Christi, Texas, a municipal corporation, hereinafter referred to as "City ", W I T N E S S E T H : WHEREAS, Lantana is the owner of certain sports facilities, and; WHEREAS, City desires to rent said sports facilities under terms hereinafter described; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS that the City and Lantana do enter into the following agreement: I City agrees to rent the building known as the "Sportatorium" from December 1, 1976 through February 28, 1977. City agrees to pay Lantana the sum of One Dollar ($1.00) as rental for this term. Rental shall be from 6:30 p.m. until 11:00 p.m. on specific dates agreed by the parties. - II Lantana agrees to: (1) Clean up the premises before and after use by City; (2) Furnish electricity and other utilities; (3) Be responsible for sale of all concessions. III City agrees to: (1) Provide officials for scheduled games; (2) Provide timekeepers and other supervisory personnel (3) Provide equipment needed for various games. IV Lantana agrees and indemnifies and holds the City of Corpus Christi harmless from and against any and all claims, liabilities, damages and expenses, including reasonable attorney's fees in defending any such claims arising v from injuries to any patrons, frequenters, and participants of any events staged by City at Sportatorium. Lantana agrees to provide insurance coverage in an amount specified by the Director of Finance. V City agrees to make available for use by Lantana the Ben Garza Gymnasium for a minimum of three basketball tournaments sponsored either directly or indirectly by Lantana on dates agreed by the parties. City agrees and indemnifies and holds Lantana harmless from and against any and all claims, liabilities, damages and expenses, including reasonable attorney's fees in defending any such claims arising from injuries to any patrons, frequenters, and participants of any events staged by Lantana at Ben Garza Gymnasium.
