SURVEY #417, AS RECORDED IN VOL. 749, PAGE 250, DEED RECORDS OF NUECES COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS HEREINAFTER; AND DECLARING AN EMERGENCY. WHEREAS, there exists a certain right -of -way easement required for drainage purposes out of the A.M. French Estate, B.S. and F. Survey #417, as recorded in Vol. 749, page 250, Deed Records of Nueces County, Texas, in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous ' to the City of Corpus Christi to abandon said easement at this time: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1.- That the right -of -way easement required for drainage purposes out of the A.M. French Estate, B.S. & F. Survey #417, recorded in Volume 749, page 250, Deed Records, Nueces County, Texas, more particularly _. described hereinafter, be and the same is hereby closed for public use and every municipal purpose, and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas, said easement to be abandoned being described as follows: Tract #l: i Bebinning at the Southwest corner of BS & F Survey 1;17, samo being in the East line of BS & F Survey 413; Thence, due Itorth along the West line of BS & F Survey 417 and the East line of BS.& F Survey 1113 and Nueces Garden #2 Subdivision a distance of 2152.8 ft. to a point, said point also being the Southeast corner of i Lot 56, Nueces Gardena #2 Subdivision and the point of beginning of this description; . .Thence, N. 890 551 E. a distance of 2281.921, more er leas, to the West Right -of -Way line of McKinzie Road for the Southeast corner of this description; i Thence, N. 110 22''W. with the West Right -of -Way line of McKinzie Road a distance of 30.591 to the Northeast corner of.this description; MI�ROF1(MEg, 13517 JUN 3 0 1980 Thence, S. 890 551 W. parallel to and 301 Korth of the first call of this description,' a distance of 2275.781, more or lese, to a point In the West line of BS & Survey 417 for the Northwest corner of this description; Thence, due south along the West line of BS & F Survey and the East line of Lot 56, Nuueces Gardens #2 Subdivision, a distance of 30 feet more or less, to the point of beginning of this description.. The above parcel of land contains 1.569 acres, more or loan. Tract #21 • Beginning at the Southesast corner of BS&F Survey 417, same being the Southwest corner of Block 17, Section 3, fiighway.Village Subdivision; Thence, due Korth along the common lino between the above mentioned Tract and in the centerline of Robb Drive, a distanco of 2851 to a point; ' Thence, duo teat a distance of 251 to a 1^ iron rod'marking the west - Right -of -Way line of Robb Drive and the North Right -of -Wily line of Kingsbury Drive; Thence, due North parallel to and 251 West of the East line of the BS&F survey and being the West Right -of -Way line of Robb Drive, a distance of 600.861, more or less, for the Southeast corner and point of beginning of this description; Thence, N. 800 451 W. a distance of 642.721, moro or less, to a point In the East Right -of -Way line of McKinzie Road for the Southwest corner of this description; Thence, N. 110 221 W. along the East Right -of -Way line of McKinzie Road a distance of -32.051, more or less, for the Northwest confer of thin description; Thence, S. 800 451 B. parallel to and 301 North of the first call of this description for a distance of 649.121, more or leaa,.to the West - Right -of -Way line of Robb Drive for the Northoaat corner of thin des- cription; Thence, due Sor•.th along the West•Right -of -Way line of Robb Drive for a distance of 30.39! to the place of beginning. The above described parcel of land contains 0.442 acres, mono or less. The two (2)'tracta in this description contain 2.011 acres of land, isore or less. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. -2- SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspen- sion of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the R& day of December, 1976.
