HomeMy WebLinkAbout13536 ORD - 12/15/1976L' AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF DAVID DAWE BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PORTION OF LOTS 7 AND 8 SECTION 53, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS , SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of DAVID DAWE for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday December 15. 1976_, at SDeCiaI Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the zoning of the following described parcels or tracts of land be and the same is hereby changed from "11-16" One Family Dwelling District to "B -4" General Business District, the said tracts being portions of Lots 7 and 8, Section 53, Flour Bluff and Encinal Farm and Garden Tracts: TRACT A Being a portion of Lot No. Eight (8), in Section No. Fifty -three (53), of the Flour Bluff and Encinal Farm and Garden Tracts, according to the official map or plat thereof recorded in Volume "A ", pages 41 to 43, both inclusive, of the Map Records of Nueces County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a point.in the Northeast boundary line of said Lot No. 8 at the point of intersection . of said line with the Southeast boundary line of a 60.0 foot public road running through said Lot No. 8 in a Northeast - Southwest direction for the Northwest corner of this tract; THENCE S 61° E along the Northeast boundary line of said Lot No. 8 approximately 180.0 feet to a point in the shoreline of Laguna Madre for the Northeast corner of this tract; THENCE in a Southwesterly direction along the meanders of the shoreline of Laguna Madre approx- imately 228.0 feet to the Northeast corner of a 0.19 acre tract described as Tract No. 1 in Deed dated August 3, 1951, from Walter L. Duncan and wife, Jessie Mae Duncan, to Humble Oil and Refining Company, said deed being recorded in Volume 524 at page 251 of the Deed Records of Nueces County, Texas, for the Southeast corner of this tract; THENCE N 610 W along the Northeast boundary line of said 0.19 acre tract approximately 237..0 feet to a point in the Southeast boundary line of the aforementioned 60,0 foot public road, the Northwest corner of said 0.19 acre tract, for the Southwest corner of this tract; THENCE in a Northeasterly direction along the Southeast boundary line of the aforementioned 60.0 foot public road a distance of 207.7 feet, more or less, to the PLACE OF BEGINNING,-con- taining one (1) acre of land, more or less. TRACTS B AND C FIELD140TES for 2.24 acres of land, more or less, out of Tract 18, Laguna Madre Acres, a map of which is recorded in Volume 11, Page 5, Map Records of Nueces County, Texas: BEGINNING at the South corner of said Tract 18 for the South corner of this tract; THENCE North 60° 58' 00" West, with the-Southwest boundary line of said Tract 18, 740.00 feet to the West corner of this tract; - THENCE North 29° 02' 00" East, 132.00 feet to a point on the common boundary line of Tracts 17 and 18, Laguna Madre Acres for the North corner of this tract; THENCE South 60° 58' 00" East, with said common boundary line of Tracts 17 and 18, 740.00 feet to the South corner of said Tract 18 for the East corner*of Tract 18 and the East corner of this tract; THENCE South 29° 02' 00" West, with the Southeast boundary of said Tract 18, 132.00 feet to the POINT OF BEGINNING. C � ' SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an Imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from an after its passage, IT IS ACCORDINGLY SO ORDAINED, this the s day of ATTEST 4 "Secrelfary • APP D.
