HomeMy WebLinkAbout13554 ORD - 01/05/1977jkh:12- 22 -76; 1st AN ORDINANCE AMENDING ORDINANCE NO. 12604, PASSED AND APPROVED BY THE CITY COUNCIL ON APRIL 23, 1975, BY AMENDING SECTION 1 OF SAID ORDINANCE SO AS TO AMEND SECTION III - BUILDING CODE BOARD OF APPEALS, BY AMENDING SUBSECTIONS 111.1 - APPOINTMENT, 111.2 - TERM OF OFFICE, AND 111.3 - QUORUM, SO AS TO EXPAND THE BUILDING CODE BOARD OF APPEALS FROM FIVE TO SEVEN MEMBERS, TO PROVIDE FOR TERMS OF OFFICE, AND TO PROVIDE THAT FOUR MEMBERS RATHER THAN THREE SHALL CONSTITUTE A QUORUM; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SAVINGS CLAUSE; AND PROVID- ING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 12604, passed and approved by the City Council on April 23, 1975, which adopted the Southern Standard Building Code, 1973 Edition and the 1974 Revision thereof, with certain exceptions, be and the same is hereby amended as follows: A. That Subsection 111.1 - Appointment, be amended to hereafter read as follows: "111.1 - APPOINTMENT. "There is hereby established a board to be called the Building Code Board of Appeals, which shall consist of seven members. Such Board shall be composed of one architect, one general contractor, one engineer, three members at large from the building industry and one member not connected with the building industry. The said board shall be appointed by the City Council." B. That Subsection 111.2 - Term of Office, be amended to hereafter read as follows: "111.2 - TERM OF OFFICE. "Members shall be appointed for terms of four years, except that upon creation of the board initial terms shall be reduced to three years for one member and two years for three members in order to stagger terms so that no more than three terms expire in any calendar year. Vacancies shall be filled for an unexpired term in the manner in which original appoint- ments are required to be made. Continued absence of any member from regular meetings of the Board shall render any such member liable to immediate removal from office." MICROFILMED 13554 O', I9g0 C. That Subsection 111.3 - Quorum, be amended to hereafter read as follows: "111.3 QUORUM. "Four members of the board shall constitute a quorum. In varying the application of any provisions of this code or in modifying an order of the Building Official, affirmative votes of the majority present, but not less than four affirmative votes, shall be required. No board member shall act in a case in which he has a personal interest." SECTION 2. That all ordinances or parts of ordinances in conflict herewith be and the same are repealed to the extent of such conflict. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. x SECTION 4.
