HomeMy WebLinkAbout13566 ORD - 01/12/1977jkh:1- 12 -77; lsi AN ORDINANCE AMENDING ORDINANCE NO. 12385, PASSED AND APPROVED BY THE CITY COUNCIL ON DECEMBER 11, 1974, BY AMENDING THE CONTRACT AUTHORIZED BY SAIDORDINANCE BETWEEN THE CITY OF CORPUS CHRISTI AND SAM PERKINS SO AS TO ELIMINATE THE REQUIREMENT THAT THE ABUTTING PROPERTY FIRST BE USED FOR PUBLIC HOUSING IN WHICH THE HOUSING AUTHORITY OF THE CITY OF CORPUS CHRISTI HAS PARTICIPATED AND REPLACE IT WITH A REQUIREMENT THAT THE PROPERTY FIRST BE USED FOR HOUSING FOR THE ELDERLY AND SO AS TO RELOCATE THE 10 -FOOT PEDESTRIAN ACCESS AND UTILITY EASEMENT REQUIRED THEREIN; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 12385, passed and approved by the City Council on December 11, 1974, be and the same is hereby amended by amending the contract authorized by said ordinance between the City of Corpus Christi and Sam Perkins as follows: A. Amend Paragraph IV, line 5, by deleting the words "public housing purposes in which the Housing Authority of the City of Corpus Christi has partici- pated" and in lieu thereof inserting the words "housing for the elderly;" said Paragraph IV to hereafter read as follows: "Buyer further agrees that the Warranty Deed to be delivered by the City upon receipt of the purchase price will contain a restriction that the conveyance will be effective only so long as a portion of the abutting property is first used for housing for the elderly, and that upon failure of said use the conveyance shall become void and the title to said property shall revert to the City of Corpus Christi, its successors and assigns, who shall have the right to reenter and repossess itself of same. Upon failure of said use, Buyer shall be returned the Nine Hundred Dollars ($900) con- sideration expended for the subject property." B. Amend Paragraph V,-line 3 of Item 1, by deleting the words "the plat attached hereto marked 'Exhibit A' and incorporated herein" and in lieu thereof inserting the words "a replat of the property and also indicated on the site plan attached to the special permit for the property," said Item 1 of said Paragraph V to hereafter read as follows: MICROFILMED :�ssb. A pedestrian access easement of 10 feet in width shall be maintained by the grantee, said 10 foot easement being shown on a replat of the property and also indicated on the site plan attached to the special permit for the property." SECTION 2. The necessity to amend Ordinance No. 12385 as herein - above set forth creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of January, 1977.
