HomeMy WebLinkAbout13578 ORD - 01/19/1977JKH:hb:1/10/77 t � AN ORDINANCE 4' AUTHORIZING THE CITY MANAGER, FOR THE CITY OF CORPUS CHRISTI AS THE ADMINISTRATIVE UNIT OF THE COASTAL BEND MANPOWER CONSORTIUM, TO SUBMIT A CETA TITLE II GRANT MODIFICATION TO THE DEPARTMENT OF LABOR, TO EXTEND THE GRANT THROUGH SEPTEMBER 30, 1977, ADD NEW FY77 FUNDS IN THE AMOUNT OF $359,840, AND DEOBLIGATE FY76 SUPPLEMENTAL FUNDS, ALL AS MORE FULLY SET FORTH IN THE GRANT MODIFICATION, A SUB - - STANTIAL COPY OF WHICH IS ATTACHED HERETO, MARKED - z EXHIBIT "A ", AND MADE A PART HEREOF; AUTHORIZING -' THE CITY MANAGER TO SUBMIT ALL OTHER REQUIRED CETA r TITLE II GRANT MODIFICATIONS, EXECUTE ALL NECESSARY AND RELATED CONTRACTS, CONTRACT MODIFICATIONS, AND DOCUMENTS IN THE IMPLEMENTATION, CONTINUATION, AND ADMINISTRATION OF THE AFORESAID GRANT MODIFICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: "SECTION 1. That the City Manager, for and on behalf of the City of Corpus Christi as the administrative unit of the Coastal Bend Manpower Consortium, be and he is hereby authorized to submit a CETA Title II Grant Modification to the Department of Labor, to extend the grant through September 30, 1977, add new FY77 funds in the amount of $359,840, and deobligate FY76 supplemental funds, all as more fully set forth in the grant modification, a substantial copy of which is attached hereto, marked Exhibit "A", and made a part hereof. SECTION 2. That the City Manager be and he is hereby authorized to submit all other required CETA Title II grant modifications, execute all necessary and related contracts, contract modifications, and documents in the implementation, continuation and administration of the aforesaid grant modification. 9 SECTION 3. The necessity to authorize submission of the aforesaid grant modification and any and all other necessary contracts and documents in order to implement, continue and administer the aforesaid s grant modification and program creates a public emergency and an im- perative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such N�ICROF1L11�ED 13578 1198D emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the / 44L day of January, 1977. These reflect a sustaining level in Title II of 55 slots. Sbecial Provision (1) Pursuant to Section 3(A)(1) arxl (2) and Section II of the Rvergency Jobs Programs Extension Act of 1976, Public Law 94.444, this special provision releases the Grant -_ from the require* ants of 96.23(b) (15) , 96.36 and 98.12(b) of the Regulations published on June 25, 1976, and substitutes the requirements in (2) below in their place. These reg,ira,mnts shall be deemed to have taken effect on the effective date of the legislation, October 1, 1976. To the extent that any provisions of the June 25 Regulations conflict with the require - nents set forth herein, the June 25 provisions shall be deemed ineffective. All other provisions of the June 25 Regulations shall remain effective until further notice. (2) Allowable Federal Costs: Restriction on use of finds in Public Service Employment Programs. (1) (i) (A) Not less than 85 percent of the fords appropriated pursuant to. the Act which are used by an eligible applicant for public service employment programs shall be expended for wages and fringe benefits to persons Toyed in public service jobs (sec. 203Cb)). (B) The remaining 15 percent may be Used for administration, training, or supportive services to participants in public service employment. However, none of the 15 percent may be used to contract for capital inprovem nts to real property used in the administration of the program. (C) An, eligible applicant which does not itself administer the entire Program nay not retain the entire 15 percent mentioned in (b)(1)(i)(D) of this section for its awn use unless this is agreed to by its subgrantees. At least 7.5 percent of a subgrant must be available to the subgrantm for costs other than wages and fringe benefits. (D) Training materials, work tools, uniforms or other equipment ordinarily provided by the employer to regular employees, and which are for the benefit and ownership of the participants may be considered fringe benefit costs for public service employment pxhrtizipants (sec. 208(a)(7). Consistent with the maintena,-Ice of effort requirements of 96.24, of this subtitle, the cost o; participants' salaries and fringe benefits shall be allowable costs when such participants are used in hare repair and winterizationfweathazation activities where such activities are considered to be services pormaily provided by government and where work performed will not inure primarily to the ber--fit of a profitmaking organization. Home recair and winterization /weatn°=ization activities shall be limited to dwellings of individuals who are at or below 125 percent of the poverty level (as defined in 94.4) which are privately owned and onmer- occupied, privately owned by a nonprofit organization, or units of public housing. Unemployment insurance benefit costs for public service employment participants, including such participants who are also administra- tive staff, who become eligible for unemployment insurance by reason of their participation in the program shall be paid not from funds under the Act, but from furls appropriated pursuant to Part B, Section 220(a) of Pub. L. 94 -444. However, administrative costs associated with the recordkeeping requirements necessary to implement Part B, Section 220(a) of Pub. L. 94 -444, shalt be allowable as an administrative cost under the Act. Fringe benefits. In order to insure special consideration for veterans, all public service employment vacancies under Title II, except those to which former employees are being recalled, must be listed with the State employment service at least 48 hours - (excluding Saturdays, Sundays, and holidays) before such vacancies are filled. During this period, the employment service may refer those veterans specified above. If sufficient numbers of veterans are not available, the employment service, upon request, may also refer members of other significant segments. All other applicants are to be referred after the 48 -hour period (section 205(c)(5)). The eligible applicant should utilize the assistance of State and local veterans employment representatives in formulating its program objectives.
