HomeMy WebLinkAbout13601 ORD - 02/02/1977jkh:2 -2 -77; 1st AN ORDINANCE AUTHORIZING AN ADDITIONAL PAYMENT TO THE COMMON FUND ESTABLISHED BY PARTICIPATING CITIES IN THE CENTRAL POWER AND LIGHT COMPANY RATE ANALYSIS FOR CONSULTANT AND LEGAL COUNSEL FEES ON A $.10 PER CAPITA BASIS IN THE AMOUNT OF $20,452.50 AS THE CITY'S PRO RATA SHARE ACCORDING TO THE POPULATION BASED ON THE 1970 FEDERAL CENSUS; APPROPRIATING AND REAPPROPRIATING OUT OF THE NO. 102 GENERAL FUND RESERVE, ACTIVITY 4299, CODE 490, $20,452.50 FOR TRANSFER TO THE NO. 102 GENERAL FUND, ACTIVITY 4281, CODE 301; AND DECLARING AN EMERGENCY. WHEREAS, by Ordinance No. 13394, passed and approved by the City Council on September 15, 1976, the City Council authorized the City of Corpus Christi to join other cities in the Central Power and Light system in the cooperative effort to determine a fair and reasonable rate for said utility and authorized the expenditure of funds, based on the contribution of 10 cents per inhabitant of the City according to the 1970 Federal Census: as`the City's pro rata share; and WHEREAS, it has been determined that additional sums, as the City's pro rata share, are now needed to continue the aforesaid cooperative effort: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That authorization is hereby given to make an additional payment to the common fund established by participating cities in the Central Power and Light Company rate analysis for consultant and legal counsel fees on a 10 cents per capita basis in the amount of $20,452.50 as the City's pro rata share, according to the population based on the 1970 Federal Census. SECTION 2. That there is hereby appropriated and reappropriated out of the No. 102 General Fund Reserve, Activity 4299, Code 490, the sum of $20,452.50 for transfer to the No. 102 General Fund, Activity 4281, Code 301, for the aforesaid payment. SECTION 3. The urgent necessity for the City of Corpus Christi to continue participating in the rate analysis and to contribute its pro rata share for consultant and legal counsel fees creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three MICROFILMED 13601 JUL 0 11980 • r • several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the- -2 day of February, 1977.
