Home My WebLink About13657 ORD - 03/02/1977• Jkh:1- 26 -77; 1st • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT WITH VALLEY GOLD DAIRY PRODUCTS COVERING LOTS 1 AND IA, McBRIDE COMMERCIAL SITES, FOR A TERM OF THREE YEARS, SAID LAND TO BE USED FOR A SUBSTATION AND TRANSFER POINT FOR TENANT'S MILK TRUCKS, ALL AS MORE FULLY SET FORTH IN THE LEASE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A ". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a lease agreement with Valley Gold Dairy Products covering Lots 1 and 1A, McBride Commercial Sites, in the City of Corpus Christi, Nueces County, Texas, for a term of three years, said land to be used for a sub- station and transfer point for tenant's milk trucks, all as more fully set forth in the lease agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". MICROFILMED JUL 07, IG30 13657 LEASE AGREEMENT STATE OF TEXAS X COUNTY OF NUECES X WHEREAS, the City is desirous of leasing certain land for a term of three (3) years, and WHEREAS, bids were duly and lawfully taken, and WHEREAS, Valley Gold Dairy Products was the successful bidder for the lease of the land and has agreed to pay an annual rental of Eighteen Hundred ($1,800) Dollars. NOW, THEREFORE, W I T N E S S E T H: 1. The City of Corpus Christi hereby agrees to lease the following described property to Valley Gold Dairy Products: Lots 1 and 1A, McBride Commercial Sites (5300 Leopard Street) 2. The term of said lease shall be for three (3) years, beginning upon the date of execution of this agreement. 3. The consideration for this lease shall be an annual payment of Eighteen Hundred ($1,800) Dollars, payable monthly, in advance, by Valley Gold Dairy Products. 4. The City of Corpus Christi may, without cause, cancel this lease by giving a sixty -day (60) notice thereof to Valley Gold Dairy Products. 5. It is agreed by Valley Gold Dairy Products that this property shall be used exclusively as a substation and transfer point for milk trucks, in conjunction with the regular business operations of Valley Gold Dairy Products. 6. Valley Gold Dairy Products agrees to maintain the premises in good and suitable condition at all times and further agrees that the installation of any facilities used in connection with its business shall be erected at its own expense and must • • be removed at the termination of this lease. In the event any permanent fixtures are not removed, they shall become the property of the City of Corpus Christi at the termination of this lease. 7. Valley Gold Dairy Products agrees to indemnify and hold harmless the City of Corpus Christi from any liability and /or claims arising out of the execution of this contract.
