Home My WebLink About13658 ORD - 03/02/1977• JXH:hb:1/26/77 ' • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT WITH JOE ROE FOR THE LEASING OF A TRACT OF LAND AT THE ALLISON WASTEWATER TREATMENT PLANT FOR A TERM OF 5 YEARS COMMENCING ON MARCH 2, 1977, AND END ON MARCH 1, 1982, IN ACCORDANCE WITH THE TERMS OF SAID LEASE, A SUBSTANTIAL COPY OF WHICH, MARKED EXHIBIT "A ", IS ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PERTINENT PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be, and he is hereby author- ized and directed to execute for and on behalf of the City of Corpus Christi, a lease agreement with Joe Roe, for a term of five (5) years commencing on March 2, 1977 and ending on March 1, 1982, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". 13658 MICROFILMED JUL 071990 JUL 0 LEASE THE STATE OF TESAS X KNOW ALL MEN BY THESE PRESENTS: COMITY OF NOECES X This contract and lease agreement made and entered into this day of , 1977, by and between the City of Corpus Christi, Texas, a municipal corporation, acting by and through its duly authorized City Manager, R. Marvin Townsend, hereinafter called Lessor, and Joe Roe of Nueces County, Texas, hereinafter called Lessee: W I T N E S S E T H: That for and in consideration of the covenants and agreements herein contained and subject to the provisions hereby, Lessor does hereby lease and demise unto Lessee the following lands and premises: Approximately 80 acres of pasture land located in Nueces County, Texas, as shown colored in green on the attached drawing. I The rental for said property shall be $240.00 per year, payable annually in advance. II The term of this lease shall be for five (5) years, to commence March 2, 1977 and to terminate at midnight on March 1, 1982. III It is further expressly covenanted and agreed by and between the parties hereto that either party shall have the privilege and right to terminate this lease at any time during its term on giving the other party sixty (60) days written notice, and upon the termination of this lease in accordance with the provisions of this paragraph, Lessee agrees to vacate the premises and shall be reimbursed for the number of months remaining on the annual installment, after the expiration of such sixty (60) day period. IV The property leased herein to Lessee is to be used for the sole and exclusive purpose of grazing livestock. It shall be further agreed • that Lessee shall maintain all fences surrounding the property and shall not erect any structures on the premises without permission from Lessor. V Lessor shall have the right to inject sewage sludge in any part of the leased area during the term of this lease. Executed in duplicate originals this the day of , 1977.
