BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute documents necessary for the acquisition of a Drainage and Utility Easement for Parcels 2 and 3 in connection with the Hearn Road Ditch, said parcels being more fully described as follows: PARCEL 2 Being a 0.775 acre tract of land out of Lot 3, Block 4, FARIAS GRANT SUBDIVISION as shown by map of record in Volume 39, Page 172, Map Records, Nueces County, Texas, said 0.775 acre tract being, more particularly described by metes and bounds as follows: Beginning at a point is the north line of said Lot 3, the south right -of -way line of Interstate Highway 37, said point being N. 760 18' 11 ", 14.01 feet from the northeast corner of said Lot 3, for the northeast and beginning corner of the tract herein described; Thence S. 160 12' 56" W., with a line that is 14.01 feet west of and parallel to the east line of said Lot 3, a distance of 460.83 feet to a point on the arc of a curve, said point not being tangent, for a corner of the tract herein described; Thence in a southwesterly direction with the arc of said curve to the right whose central angle is 190 31' 41 ", and whose radius is 190.0 feet, an arc distance of 63.10 feet to a point in the south line of said Lot 3, for the southeast corner of the tract herein described; Thence N. 550 24` 09" W., with the south line of said Lot 3, a distance of 95.17 feet to a point in the are of a curve for the southwest corner of the tract herein described; Thence in a northeasterly direction with the are of a curve to the left whose central angle is 550 08' 58" and whose radius is 105.0 feet, an are distance of 101.07 feet to a point for the P.T. of said curve and a corner of the tract herein described; M'IOROFILWD '.3674- ,1[1! 0 7 1980 Thence N. 160 12' 56" E., with a line that is 89.0 feet west of and parallel to the east line of said Lot 3, a distance of 367.03 feet to a point in the south line of a 0.102 acre tract of land in the name of Guy Nunnally and described in Volume 1242, Page 271, Deed Records, Nueces County, Texas for a corner of the tract herein described; Thence S. 760 15' 52" E., with the south line of said 0.102 acre tract of land, a distance of 5.57 feet to a point in the west line of a drainage easement conveyed to the State of Texas High- way Commission and described in Volume 1159, Page 330, Deed Re- cords, Nueces County, Texas, for a corner of the tract herein described; Thence S. 120 00' 05" E., with the west line of said drainage. easement, a distance of 93.87 feet to a point for an interior corner of the tract herein described; Thence S. 730 47' 04" E., with the south line of said drainage easement a distance of 15.0 feet to a point, the southeast corner of said drainage easement for an interior corner of the tract herein described; Thence N. 160 12' 56" E., with the east line of said drainage easement, a distance of 115.0 feet to its northeast corner thereof in the south right -of -:ray line .of said Interstate High- way 37, for a corner of the tract herein described; Thence S. 760 18' 11" E., with the south right -of -way line of said Interstate Highway 37, a distance of 10.08 feet to the point of beginning; Containing 0.775 acre of land more or less. PARCEL 3 Being a 0.589 acre tract of land out of that certain 2.75 acre tract in the name of Vernon Coleman, described in Volume 1421, Page 601, Deed Re- cords, Nueces County, Texas, said 0.589 acre tract being more particularly described by metes and bounds as follows: Beginning at a point in the north line of said 2.75 acre tract, the south line of Lot 3, Block 4, FARIAS GRANT SUBDIVISION, as shown by map of re- cord in Volume 39, Page 172, map records, Nueces County, Texas, said point being N. 550 24' 09" W., 46.02 feet from the northeast corner of said 2.75 acre tract and in the arc of a curve of a proposed drainage easement for the northeast and beginning corner of the tract herein described; Thence in a southwesterly direction with the are of a curve to the right whose central angle is 380 48' 01" and whose radius is 190.0 feet, an arc distance of 128.67 feet to a point, the P.C.C. of curves for a corner of the tract herein described; Thence in a southwesterly direction with the are of a curve to the left whose central angle is 550 22' 30" and whose radius in 90.00 feet, an are distance of 86.98 feet to a point, the P.T. of said curve for a corner of the tract herein described; . Thence S. 370 20' 26" W., a distance of 135.48 feet to a point in the west line of said 2.75 acre tract for the most southerly corner of the tract herein described; -2- • • Thence N. 100 01' 56" E., with the west line of said 2.75 acre tract, a distance of 205.18 feet to a point in the arc of a curve of a proposed drainage easement from whence the northwest corner of said 2.75 acre tract bears N. 106 O1' 56" E., 131.03 feet for the most westerly corner of the tract herein described; Thence in an easterly direction with the arc of a curve to the right whose central angle is 410 06' 12" and whose radius is 190.0 feet, an are distance of 136.30 feet to a point, the P.C.C. of curves for a corner of the tract herein described; Thence in an easterly direction with the are of a curve to the left whose central angle is 130 49' 19" and whose radius is 90.0 feet, an are distance of 21.71 feet to a point in the north line of said 2.75 acre tract, the south line of said'Lot 3, for the northwest corner of the tract herein described; Thence S. 550 24' 09" E., with the north line of said 2.75 acre tract, the south line of said Lot 3, a distance of 114.88 feet to the point of beginning. Containing 0.589 acre of land more or less. A map of which is marked "Exhibit A" and attached hereto and made a part hereof for all purposes. SECTION 2. That there is hereby appropriated out of the 295 Storm Sewer Bond Fund the sum of $4,720 applicable to Project 295 -70-70 and $1,180 out of the 250 Sanitary Sewer Bond Fund applicable to Project 250 -72 -7, all for the acquisition of easements for Parcels 2 and 3, Hearn Road Ditch, SECTION 3. The necessity to authorize execution of the docu- ments necessary to acquire the aforesaid parcels and to appropriate sufficient funds for acquisition of the aforesaid drainage and utility easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the I!g(jday of March, 1977. �} ATTEST: • ►— 'City Secretary MAYORProjeal T CITY OF CORPUS HRISTI, TEXAS APPROVED�DAY OF MARCH, 1977: J.
