AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT
WITH BLACK AND VEATCH CONSULTING ENGINEERS FOR PER-
FORMANCE OF ENGINEERING SERVICES CONSISTING OF PRE-
PARATION OF A WATER RATE STUDY TO INCLUDE DETERMINA-
TION OF REVENUE REQUIREMENTS, ALLOCATION OF COSTS,
AND DESIGN OF WATER RATES, ALL AS MORE FULLY SET
FORTH IN THE CONTRACT, A SUBSTANTIAL COPY OF WHICH
IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED
EXHIBIT "A "; APPROPRIATING AND REAPPROPRIATING OUT
OF THE WATER FUND NO. 141 THE AMOUNT OF $38,000 FOR
THE AFORESAID STUDY; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be and he is hereby authorized
to execute a contract with Black and Veatch Consulting Engineers for per-
formance of engineering services consisting of preparation of a water rate
study to include determination of revenue requirements, allocation of costs,
and design of water rates, all as more fully set forth in the contract, a
substantial copy of which is attached hereto and made a part hereof, marked
Exhibit "A ".
SECTION 2. That there is hereby appropriated and reappropriated
out of the No. 141 Water Fund the sum of $38,000 for the aforesaid study.
SECTION 3. The necessity to authorize execution of the aforesaid
contract and appropriation of the necessary funds to carry out the terms
of the contract creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordinance
or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared such emergency and necessity to exist, and
having requested the suspension of the Charter rule and that this ordinance
be passed finally on the date of its introduction and take effect and be
in full force and effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED, this the aday of March, 1977.

CONTRACT FOR EAGIHEERMG SERVICES
THIS CONTRACT, made and executed in duplicate this day of ,
1977, by and between the City of Corpus Christi, Texas, hereinafter called
the City, party of the first part, and Black & Veatch, Consulting Engineers,
of Vaasaa City, Missouri, hereinafter called the Engineers, party of the
second part;
WITHESSETH: That in consideration of the mutual covenants herein contained,
the City hereby agrees to employ the Engineers to perform engineering services
hereinafter set forth, and the City hereby agrees to pay the Engineers for
said engineering services according to the schedule of fees herein specified.
SECTION I. Ilia services which the Engineers agree to perform comprise the
preparation of a water rata study which is to include determination of
revenue requirements, allocation of costa of service, and design of water
rates. Said water rate study shall consist of the following stepst
1. Develop revenue requirements of the water utility based on
financial records to be furnished by the City. The revenue
requirements will include operation and maintenance expense,
routine annual capital additions and replacements, payment in
yT n lieu of taxes, principal and interest on etd.sting; and proposed
\JS�% bond issues, and all other costs associated or expected to be
associated with the operation of the water utility as specified
by the City. The annual revenue requirements will be projected
for a period of at least five years in the future.
2. Allocate the revenue requirements, or total cost of services
provided by the water utility, to the various cost of service
components which constitute a functional classification of
the different types of service the water utility provides to
customers. Major classifications of the cost of service
components shall include costs which vary directly with
the total quantity of water used, costs associated with
meeting water demands in excess of the average rate of use,
and costs which vary in proportion to the number of customers
connected to the system. Special consideration will be given
to determine the costa to raw water use as may be affected by
the Choke Canyon Dam project during the projection period.

3. Determine water usage and demand characteristics of each
customer classification based on experience. statistical data,
and applicable conditions in Corpus Christi. Demand data will
be based upon the Engineers 1969 study on water rates to the
maximum extent possible, supplemented only as necessary to
determine current conditions. Customer classifications may
include residential, multiple - residential, commercial. industrial,
raw water and other special services.
4. Distribute the functional cost of service component costs for a
test year to the various customer classifications on the basis of
the relative responsibility of each classification for services
provided as determined from the customer classification
characteristics.
5. Estimate the revenues, under the existing schedule of water rates,
anticipated from each customer classification for a teat year and
compare such revenues with the distributed functional cost of
service component costs and determine the adjustment in revenues
for each classification required to equitably distribute total
cost of service to the respective classifications.
6. Design a schedule of water rates which will recover the revenue
requirements of the customer classes in accordance with the cost
of service analysis giving consideration to adjustment of cost
of service rates for practical considerations.
7. The results of the water rate study will be summarized in a formal
report, sufficient copies of which will be furnished the City for
Its use. Such report shall contain supporting data related to the
study. The report will be delivered personally and presented by a
representative of the Engineers on a date agreeable to the City.
SECTION U. It is mutually understood and agreed that the City will provide,
at its own expense. the following items:
1. All maps, plans, records, statistical and financial data, reports
by others, etc., which are related to the water utility and deemed
useful in the work involved under this contract.
2. An analysis of customer water use for the most recent fiscal year
as may be necessary to adjust data received in 1969 for the last
comprehensive water rate study. Such data to include specific
month by month water use of raw water and large treated water
customars for at least an annual period.
3. The major capital improvement program of the water utility for
at least a five year period. Such a program shall contain a
description of the projects, their estimated cost, and probable
time of need.
4. Office desk space for the Engineers' personnel while in Corpus
Christi.

SECTION III. For all the services set forth in Section I. the City agrees to
pay the Engineers a fee equal to the sum of (1) twice payroll costa. which
consist of salaries, and twenty —five (25) per cant direct payroll overhead,
of all personnel charges to the work and (2) an direct expenses at actual
cost, including travel and subsistence away from the was City office,
long distance telephone, reproduction, and similar expanses. The fee for
the water rate study as outlined in Section I, so computed shall not exceed
Thirty —Eight Thousand Dollars ($38.000). Statements for work performed shall
be made on a monthly basis.
Work in addition to that outlined in Section I may be performed by the
Engineers upon written authorization of the City. In such an event, the
fee for such work shall be on the basis stated above, except that it will
not be included within the maximum limit. Such extra worts specifically
Includes conferences, meetings and appearancev after final completion and
presentation to the City.
SECTION IV. After execution of this agreement, the Engineer shall proceed
only after written authorization to proceed is received from the City.
SECTION V. The City may at any time, with or without cause terminate this
O agreement by giving the Engineers notice in writing. In the event this
agreement is terminated, the Engineer shall be compensated for the services
rendered up to the time termination notice is received and upon delivery to
the City of all worts completed.
SECTION VI. The Engineer shall not assign,sublet or transfer any of his
obligations or duties under this contract to any other persons without the
prior written conseai of-the Ucy.
SE Z= VII. The Engineers recognize that the City, desires to receive as
much data on water rates as may be practical prior to August Ip 1977p the
beginning of the nest Fiscal Year. Based upon timely notice to.proceed
y7 and receipt of information from the City, the Engineers agree to provide
data and information on revenue requirements and rates necessary for budget
purposes, as may be required prior to August 1. A final report will be
completed not later then 180 days following the notice to prowed.-
IN WITNESS WHEREOF, the parties of the first and second parts have hereunto
