HomeMy WebLinkAbout13688 ORD - 03/02/1977• JRH:hb:3 /2/77 AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE WATER CONTRACT BETWEEN THE CITY OF CORPUS AND THE VIOLET WATER SUPPLY CORPORATION PREVIOUSLY AUTHORIZED BY ORDINANCE NO. 13643; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Manager is hereby authorized and directed to execute an addendum to the Water Contract between the City of Corpus Christi and the Violet Water Supply Corporation, as more fully described in Exhibit "A" attached hereto and made a part hereof for all purposes. SECTION 2. The necessity to authorize an amendment to the water contract between the City of Corpus Christi and the Violet Water Supply Corporation at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the anoi day of March, 1977. Acquisition by City. It is agreed that at some time during the life of this contract the City may determine that it is necessary and desirable, for the proper management, expansion, and opera- tion of its water supply and distribution system, to provide service in some or all of the areas served by the Corporation, and in pursuance thereof to acquire all or part of the Corporation's facilities. In such event, upon written request by the City, the Corporation agrees to enter into negotiations for the sale or transfer to the City of all or part of its system; provided, that the consideration for the sale shall be fair and reasonable, and the terms of the sale shall be approved by the State regulatory agencies having jurisdiction, and by the Farmers Home Administration of the United States of America as its indebtedness regulations may require, shall not impair the ability of the Corporation to serve its remaining customers, and shall provide for the continuance of service to the customers in the acquired area.
