A RESOLUTION URGING DEFEAT OF HOUSE BILL 1200 INTRODUCED BY REPRESENTATIVE NUGENT AND OTHERS, WHICH, IF PASSED WOULD IMPOSE A TAX LEVY OF 5% OF THE MARKET VALUE OF CRUDE OIL AND PETROLEUM DISTILLATE CONSUMED BY EACH REFINERY FOR THE PURPOSE OF BEING REFINED; INSTRUCTING THE CITY SECRETARY TO PROVIDE A TRUE COPY OF THIS RESOLUTION TO THE NUECES COUNTY DELEGATION; AND DECLARING AN EMERGENCY. WHEREAS, Representative James E. Nugent of Kerrville, and others, have introduced House Bill 1200, which, if passed, would impose a tax levy of 52 of the market value of crude oil and petroleum distillate consumed by each refinery for the purpose of being refined, and WHEREAS, such legislation would impose an undue burden on refiners and ultimately consumers of petroleum distillate products and, in addition, severely hamper the economic well —being of those areas in Texas wherein refining plays a significant role in the overall economy, and WHEREAS, the 5% tax which would be imposed by the legislation could cause the refining industry of Corpus Christi and other Texas port cities to lose their competitive position in the industry resulting in possible relocation to Gulf of Mexico ports outside of Texas, and TEAS, since a portion of the proceeds of the tax would be used to support public schools in lieu of school district operations and maintenance ad valorem taxes now being levied, a substantial reduction in the proceeds of the tax because of a future decrease in the supply of crude oil or an oil embargo would have a detrimental effect on the ability of the State and its school districts to provide adequate public education, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Council of the City of Corpus Christi hereby urges the immediate defeat of House Bill 1200 or similar legislation which would impose a 5% tax levy on petroleum distillates and crude oil to be refined. SECTION 2. The City Secretary is hereby instructed to provide each member of the Nueces County Legislative Delegation and each member .MICROFILMED,. 13706 JUL 0 7 d980 • of the Ways and Means Committee in the House of Representatives a true copy of this resolution. SECTION 3. That the necessity to promptly advise the members of the Texas Legislature of the views of the Corpus Christi City Council regarding proposed burdensome and unfair tax levies detrimental to the economy creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this resolution take effect and be in full force and effVt from and after its passage, IT IS ACCORDINGLY SO RESOLVED this the _ day of March, 1977.
