HomeMy WebLinkAbout13713 RES - 04/20/1977• JKH:vp:4 /20/77:lst • A RESOLUTION WHEREAS, Senator Jack Ogg of Houston has introduced Senate Bill No. 978 relating to the operation of motor vehicles on public beaches; WHEREAS, Senate Bill No. 978 would eliminate motor vehicle traffic on all beaches in the State and thereby severely restrict access to miles of beaches by those citizens unable to own homes or condominiums on or near public beaches; WHEREAS, although Senate Bill No. 978 authorizes the Texas Parks and Wildlife Department to construct parking lots for motor vehicles adjacent to public beaches, no appropriations are made in the bill for said construction; WHEREAS, the cost of providing parking lots for the thousands of motor vehicles using public beaches and the cost of providing transportation to beach visitors would be exorbitant and a burden on the taxpayers of the State; WHEREAS, the construction of sufficient parking areas and access to the beaches would result in severe damage to the dune system on Padre and Mustang Island which protects the islands and portions of the Coastal Bend area from tide erosion and tropical storms; WHEREAS, Nueces County presently provides adequate regulation and control of beach traffic for the safety of those citizens using the beaches as authorized by State law; WHEREAS, because the expanse, access to, and proximity to popu- lation centers of beaches vary between each county and municipality along the Gulf Coast, statewide regulation is impractical and beach traffic regulation is best left to the counties and municipalities of the Texas Gulf Coast; WHEREAS, Senate Bill No. 978 has been heard by the Senate Committee on Intergovernmental Relations; WHEREAS, the Committee reported favorably on Senate Bill No. 978 with some amendments, none of which change the basic intent of the bill; WHEREAS, since Senate Bill No. 978 will be scheduled for considera- tion on the Senate floor in the near future, it is imperaNve that the City rJU! p 71980 JL3'7:13 Council of the City of Corpus Christi make known its views concerning the bill in a timely manner; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. The City Council of the City of Corpus Christi strongly opposes the passage of Senate Bill 978 or similar proposed legislation which would limit access to public beaches by prohibiting motor vehicle traffic thereon and firmly believes that such regulation should remain with the counties and municipalities along the Texas Gulf Coast; and expresses further opposition because the construction of beach parking lots as authorized by the Bill would be detrimental to the ecology of many Gulf Coast beaches, particularly Padre and Mustang Islands. SECTION 2. The City Secretary is hereby instructed to send true copies of this resolution to Governor Dolph Briscoe, Lt. Governor Bill Hobby, Senator Carlos Truan, all other members of the Texas Senate, the Nueces County legislative delegation in the Texas House of Representatives, and the Nueces County Commissioners Court. SECTION 3. The necessity to defeat legislation limiting vehicular traffic on public beaches creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the -ZD� day of April, 1977. The City Council has directed me to forward this Resolution to you so that you may be aware of the strong feeling the citizens of Corpus Christi and this area have about this matter that so vitally affects the Coastal Bend. Should Senate Bill No. 978, or similar legislation, become law, the detrimental effect to this area would be tremendous.
