HomeMy WebLinkAbout13714 ORD - 04/20/1977• JKH:bb:4 /6/77 • AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, BY AMENDING SECTIONS 53- 99 AND 53-100 SO AS TO RESTRICT THE OPERATION OF TRUCKS, TRAILERS AND OTHER HEAVY AND /OR LARGE VEHICLES ON CERTAIN STREETS, ALL AS MORE FULLY SET FORTH HEREINAFTER; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING FOR SEVERANCE; AND PRO- VIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances, City of Corpus Christi, 1976 Revision, be and the same is hereby amended by amending Sections 53-99 and 53-100 to hereafter read as follows: Sec. 53 -99. Operation of trucks, trailers and other heavy vehicles restricted on certain streets. (a) It shall be unlawful for the operator of any truck or trailer, or the operator of any vehicle which has a capacity in excess of one (1) ton according to the manufacturer's rating, to drive or operate such truck, or such truck and trailer, or such vehicle, upon any of the following public streets or parts thereof: Louisiana Ave Ocean Drive, between the northernmost end thereof and the intersection of Alameda Street. Shoreline Boulevard (b) It shall be a defense to a charge under this section that the person so charged show by competent evidence that the operation of any truck, or any truck and trailer, or any vehicle described in this section was crossing Shoreline Boulevard for the purpose of going to or returning from the barge docks, the "T" heads or the "L" head or that any such truck or trailer, or any other vehicle was being used in the process of con- structing, maintaining or repairing any part or portion of Ocean Drive, Shoreline Boulevard, or any part or portion of the parkways thereof, or any part or portion of the Bayfront Improvement Project. (c) It shall be a defense to a charge under this section that the person so charged show by competent evidence that the operation of MICROFILMEDil JUL 0 7190 13714 any truck, or truck and trailer, or vehicle was making a delivery or pickup from any point on Louisiana Avenue. (d) It shall be a defense to a charge under this section that the person so charged show by competent evidence that any truck, or truck and trailer, or other vehicle described in this section, was making a delivery or pickup from any point on Shoreline Boulevard or Ocean Drive; provided, that ingress or egress to Ocean Drive or Shoreline Boulevard is from or to the nearest intersection to the point of delivery or pickup. (e) It shall be a defense to a charge under this section that the person so charged show by competent evidence that any truck, or truck and trailer, or vehicle, was using a portion of Ocean Drive, not to exceed one block thereof, when making a delivery within one block west of Ocean Drive on any street which intersects Ocean Drive, as a means of ingress or egress. (f) The provisions of this section shall not be construed to apply to passenger buses. Sec. 53 -100. Certain trucks, trailers and other large vehicles restricted to through streets. Except as otherwise restricted in this chapter, no truck, truck - trailer or other vehicle drawn or propelled by motor power and having a capacity in excess of one (1) ton according to the manufacturer's rating shall be permitted on any of the streets of the city except through streets as listed in section 53 -251, Schedule II, provided that where the origin or destination of a delivery or pickup by a truck requires the driving on streets other than those listed in such Schedule II, that part of such trip to the point of delivery or pickup may be made otherwise than on the through street, provided such part of such trip be made by the shortest and most direct route from or to the nearest through street. Where the origin or destination of a delivery or pickup is industrial or business zoned property which has access from both residential and through streets, trucks shall be required to use only the through street even though it may not be the shortest and most direct route. -2- It shall be a defense to a charge under this section that the person so charged show by competent evidence that the truck, truck - trailer, or other vehicle was making a delivery or pickup on the residential street, in which case trucks shall not park on residential streets for a continuous period exceeding eight (8) hours. SECTION 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION 3. If for any reason any section, paragraph, sub- division, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent Jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4.
