HomeMy WebLinkAbout13721 ORD - 05/04/1977/77 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT BETWEEN THE CITY AND THE NOECES COUNTY COMMUNITY ACTION AGENCY WHEREBY THE CITY'S NUTRITION PROGRAM WILL PREPARE AND SERVE NOONDAY MEALS FIVE DAYS PER WEER TO HEADSTART PARTICIPANTS AT THE HLALCO MULTI- PURPOSE CENTER, ALL AS MORE FULLY SET FORTH IN THE CONTRACT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT AND DECLARING AN EMERGENCY. BE IT ORDAINED BY TBE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a contract between the City and the Nueces County Community Action Agency whereby the City's Nutrition Program will prepare and serve noonday meals five days per week to Headstart participants at the HIALCO Multi- Purpose Center, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit 'W'. SECTION 2. The necessity to authorize execution of the afore- said contract in order that Headstart participants may participate in the City's Nutrition Program at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the _day of May, 1977. ATTEST: C ty Secretary MAYOR THE CITY OF CORPUS CHRISTI, TEXAS APPR DAY OF MAY, 1977: By Assistant Ci Attorney 3a 0 71 Rr 13721 A G R E E M E N T THE STATE OF TUAS X COUM OF NDECES x This agreement is made this day of , 1977, by and between the City of Corpus Christi, a municipal corporation, and body politic operating under a home rule charter authorized under the laws of the State of Texas, having its office at 302 South Shoreline, herein- after designated as the "City" and the Nueces County Community Action Agency, a private, nonprofit corporation organized and existing under the laws of the State of Texan with administrative offices at 3105 Leopard Street, Suite One, in Corpus Christi, Texas, hereinafter designated as the "Agency ". in consideration of the payments and mutual promises and covenants contained herein, the Agency and the City contract and agree as follows: 1. The City will prepare and serve a noonday meal five days per week to Headstart participants at HIALCO Multipurpose Center. The overall management of the Headstart meal program will be the responsibility of the City. 2. The City will be reimbursed by the Agency at the rate of $.73 -1/4 per meal. The rate of reimbursement includes a payment in lieu of commodities at a rate of $.13 -1/4 per meal. 3. The City will submit monthly reimbursement requests retro- active to December 1, 1976. 4. This agreement will be in effect as of the day of , 1977. However, either party may at any time during the life of the agreement or any extension thereof terminate this agreement with respect to preparation and serving of meals by giving thirty (30) days notice in writing to the other party of its intention to do so. All notices to the City shall be addressed to P. 0. Box 9277, Corpus Christi, Texas 78408, and all notices to the Agency shall be addressed to 3105 Leopard Street, Suite One, Corpus Christi, Texes 78408. Rene Ramirez Board Chairman Corpus Christi, Texas _day of/� 19 %% TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of.the City Council.
