AN ORDINANCE
AMENDING THE RULES AND REGULATIONS OF THE CIVIL SERVICE
BOARD BY ADDING TO ARTICLE FOUR, SUSPENSIONS AND APPEALS,
A NEW SECTION, TO BE DESIGNATED SECTION 6. TO PRO
FOR WRITTEN NOTICE TO CLASSIFIED EMPLOYEES WHO HAVE
COMPLETED SIX MONTHS OF PROBATIONARY SERVICE, OF CONTEM-
PLATED SUSPENSION OR DEMOTION AND TO PROVIDE OPPORTUNITY
FOR SAID EMPLOYEES TO REBUT THE CHARGES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERANCE;
AND DECLARING AN EMERGENCY.
WHEREAS, the Civil Service Board has recommended that the City
Council approve an amendment to the Civil Service Rules and Regulations
so as to provide that no classified employee who has completed six months
of probationary service shall be temporarily or indefinitely suspended or
demoted for disciplinary reasons unless such employee has first been given
written notice of the reasons for such suspension or demotion and an
effective opportunity to rebut:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That, in accordance with the recommendation of the
Civil Service Board, Article Four of the Rules and Regulations of the Civil
Service Board, as amended, be and the same is hereby amended by adding a
new section to be designated as Section 6, to hereafter read as follows:
Section 6: No classified employee who has completed
six months of probationary service shall be temporar-
ily or indefinitely suspended, nor shall any such
employee be demoted for disciplinary reasons, unless
that employee has first been given written notice of
the reasons for such suspension or demotion and an
effective opportunity to rebut those reasons within
a reasonable time after the occurrence of the last
act relied upon as a reason for such suspension or
demotion."
SECTION 2. That all ordinances or parts of ordinances in conflict
herewith shall be and are repealed to the extent of such conflict.
SECTION 3. If for any reason any section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction
It shall not affect any other section, paragraph, subdivision, clause,
phrase, word, or provision of this ordinance, for it is the definite intent
of this City Council that every section, paragraph, subdivision, clause,
phrase, word, or provision hereof be given full force an ect for its

SECTION 4. The fact that the authority granted herein to the
Civil Service Board is immediately necessary for the efficient administra-
tion of the classified civil service system of this City creates a public
emergency and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, and having requested the
suspension of the Charter rule and that this ordinance be passed finally
on the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
