A RESOLUTION
WHEREAS, various proposed legislation has been introduced in
the Texas State Legislature, including House Bill 1643 and Senate Bill 819,
which would prohibit incorporated cities from requiring, as a condition
of approval of a subdivision plat, the dedication of any portion of land
for park purposes; and
WHEREAS, for many years cities have acquired park sites by
requiring the subdividers to dedicate a minimal portion as a condition
of plat approval; and
WHEREAS, the City of Corpus Christi has had such a mandatory
requirement as a policy since 1939; and
WHEREAS, the City of Corpus Christi formalized this policy in
1955 as a required procedure set out in the revised Platting Ordinance;
and
WHEREAS, open spaces acquired through this process now account
for approximately 375 acres of neighborhood parks which would not other-
wise exist; and
WHEREAS, this imposes no undue financial burden or illegal
confiscation of property on subdividers:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. The City Council of the City of Corpus Christi
unequivocally opposes the passage of legislation which would prohibit
the requirement of park land dedication as a condition of subdivision
plat approval.
SECTION 2. The City Secretary is instructed to furnish true
copies of this Resolution to the Governor of the State of Texas, to the
Lt. Governor, Speaker of the House, and all members of the House of
Representatives
and the Senate of the Legislature of the State of Texas.

requiring the suspension of the Charter rule that no ordinance or resolu-
tion shall be passed finally on the date of its introduction but that such
ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor having declared such emergency and necessity
to exist, having requested the suspension of the Charter rule and that
this resolution take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO RESOLVED, this the 18th day of
May, 1977.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.

Enclosed is a certified copy of Resolution No. 13737, passed and
approved by the Corpus Christi City Council on May 18, 1977.
This Resolution expresses the Council's opposition -to Rouse Bill
1643 and Senate Bill SP which propose to prohibit incorporated
cities from requiring, as a condition of approval of subdivi-
Sion plat, the dedication of any portion of land for park purposes.
It is the hope of the City Council that you take into'considera
tion -this Resolution when these bills are presented in the legis-
lature.
