HomeMy WebLinkAbout13741 ORD - 05/23/19770 jkh:5- 23 -77; 1st AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BY AMENDING ARTICLE 31. NEWLY ANNEXED TERRITORY. BY AMENDING SECTION 31- KtYtAL1Nb ALL UKUMAKEb 1N LUNtLILI HtKtWlIH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendments to the text of the Zoning.Ordinance of the City of Corpus Christi, Texas; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on May 23, 1977, at Special Council Meeting of the City Council in the City Council Chambers at City Hall in the City of Corpus Christi; and the City Council further finds that the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the Zoning Ordinance; and, that permanent zoning should be granted to the tracts of land as described hereinafter; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of 6� �� nC 1,274x4_ record in Volume 9, pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be and the same is hereby amended by making the changes hereinafter set out. SECTION 2. There is hereby amended Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31 -5, by adding thereto three new subsections to be numbered Subsections 31 -5.14, 31 -5.15 and 31 -5.16, said new subsections to hereafter read as follows: "31 -5.14 The following described tract of land shall be zoned and classified as 'B -1' Neighborhood Business District: A 2.479 acre tract of land, more or less, out of.Lot 17, Section 5, Flour Bluff & Encinal Farm & Garden Tracts, as recorded in Volume A,• Pages 41 -43, Map Records, Nueces County, Texas, said tract being more fully described as follows: BEGINNING at. a point which is the nothernmost corner of said Lot 17, said point being the center line intersection of Everhart Road and Snowgoose Road for the northernmost corner and POINT OF BEGINNING of this tract; THENCE S. 611 E 240 feet along the centerline of said Snowgodse Road to a point for the easternmost corner of this tract; THENCE S 290 W 450 feet to a point for the southernmost corner of this tract; THENCE N 610 W 240 feet to a point in the centerline of said Everhart Road for the westernmost corner of this tract; THENCE N 290 E 450 feet along the centerline of said Everhart Road to the POINT OF BEGINNING. "31 -5.15 The following described tract of land shall be zoned and classified as 'A -1' Apartment House District: A 11.207 acre tract of land, more or less, out of Lot 17, Section 5, Flour Bluff & Encinal Farm & Garden Tracts, as recorded in Volume A, Pages 41 -43, Map Records, Nueces County, Texas, said tract bung more ' fully described as follows :. BEGINNING at a point which is the easternmost corner of said Lot 17, said point being in the centerline of SnoN000se Road for the easternmost corner and POINT OF BEGINNING of this tract; THENCE S 291 W 903.30 feet along the southeast boundary line of said Lot 17 to a point for the southernmost corner of this tract;- -2- • THENCE N 610 W 660 feet to a point in the centerline of Everhart Road for the westernmost corner of this tract; THENCE N 290 E 453.30 feet along the centerline of said.Everhart Road to a point for a westerly corner of this tract; THENCE S 290 E 240 feet to a point for an interior corner of this tract; THENCE N 290 E 450 feet to a point in the centerline of said Snowgoose Road for a northerly corner of this tract; THENCE S 610 E 420 feet along the centerline of said Snowgoose Road to the POINT OF BEGINNING. "31 -5.16 The following described tract of land shall be zoned and classified as 'R -2' Multiple Dwelling District: A 6_159 acre tract of land, more or less, out of Lot 17, Section 5, Flour Bluff & Encival Farm & Carden Tracts, as recorded in Volume A, Pages 41 -43, Map Records, Nueces County, Texas, said tract being more fully described as follows: BEGINNING at a point in the centerline of Everhart Road, said point being located S 290 W 903.3 feet as measured along the centerline of Everhart Road from the northernmost corner of said Lot 17 for the northernmost corner and POINT OF BEGINNING of this ,tract; THENCE S 610 E 660 feet to a point in the southeast boundary line of said Lot 17 for the easternmost corner of this tract; THENCE S 290 17 406.5 feet along the southeast- boundary line of said Lot 17 to a point for the southernmost corner of this tract; THENCE N 610 W 660 feet to a point in the centerline of Everhart Road for the westermost corner of this- tract; THENCE N 290 E 406.5 feet along the centerline of said Everhart Road to the POINT OF BEGINNING." SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 4. Publication shall be .made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 5. The necessity for making the aforesaid change immedi- ately for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension -3- of the Charter rule and that this ordinance take effect and be in full force and effect from and after its Passage, IT IS ACCORDINGLY SO ORDAINED, this the-2-�&4day of May, 1977.
