BUERGER BY WARRANTY DEED A PARCEL OF LAND DESCRIBED AS THE WEST 25 FEET OF LOT 16, BLOCK 4, FLOUR BLUFF ESTATES NO. 2, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, UPON PAYMENT OF $725 CASH CONSIDERA- TION FOR SAID PARCEL, A COPY OF INSTRUMENT OF CONVEY- ANCE BEING ATTACHED HERETO AND IMDE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY.OF CORPUS CHRISTI, SECTION 1. That the City Manager be authorized to convey to Robert W. Buerger by warranty deed a parcel of land described as the west 25 feet of Lot 16, Block 4, Flour Bluff Estates No. 2, being a vacant tract generally described as 25' x 1651, in the City of Corpus Christi, Nueces County, Texas, upon the payment of the cash consideration of $725 for said parcel of land, a copy of deed of conveyance being attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. The necessity to immediately authorize the execution of a deed in order to facilitate the sale of the above described parcel of land creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the %S day of May, 1977. J111 0 71980 Assistant Cit tt rney 1 371/5 • SPECIAL WARRANTY DEED THE STATE OF TEXAS I KNOW ALL MEN BY THESE PRESENTS: COUNTY OF NUECES Q • That the City of Corpus Christi, hereinafter called Grantor, for and in consideration of the sum of Seven Hundred Twenty -Five Dollars ($725) to Grantor in hand paid by Robert W. Buerger, the receipt of which is hereby acknowledged, and for which no lien is retained, either expressed or Implied, has this day sold, and by these presents does GRANT, BARGAIN, SELL and CONVEY unto Robert W. Buerger all that certain tract or parcel of land lying and being situated in the County of Nueces, State of Texas, more particularly described as follows, to -wit: Being described as the west 25 feet of Lot 16, Block 4, Flour Bluff Estates No. 2, in the City of Corpus Christi, Nueces County, Texas, also known and described as 632 Claride Street. TO HAVE AND TO HOLD the above described premises herein conveyed, together with all and singular the rights and appurtenances thereto in anywise belonging to the said Robert W. Buerger, his heirs and assigns, forever, and Grantor does hereby bind itself, its successors and assigns, to warrant and forever defend all and singular the said premises herein conveyed against every person whomsoever lawfully claiming or to claim the same or any part thereof by, through, or under Grantor. Grantor does hereby impress such property with the following restrictions, which restrictions shall be in addition to any valid and existing restrictions of record affecting said property: A. Grantee, his heirs and assigns shall, within six (6) months of the date of this conveyance, construct or cause to be constructed a standard screening fence along the west and rear property lines of the hereinabove described tract or parcel. If such screening fence is not constructed within six (6) months, the parcel or tract aforesaid shall revert to the Grantor herein, and Grantor will refund the purchase price to the then current owner. B. The parcel or tract hereby conveyed shall not be used or , sold independently of the East 75 feet of Lot 16, Block 4, Flour Bluff Estates No. 2, and these.restrictions and covenants are hereby declared to be covenants running with the land forever and shall be fully binding xxI'l .;�. • upon all persons acquiring the above described property whether by descent, devise, purchase or otherwise, and any person by the acceptance of title to said property or any part thereof shall thereby agree and covenant to abide by and fully perform the foregoing restrictions and covenants. Invalidation of any one or any part of these restrictions or covenants by judgment or court order shall in no wise affect any of the other provisions or parts of provisions which shall remain in full force and effect.
