HomeMy WebLinkAbout13746 ORD - 05/25/1977c • JKH:vp:5 /25/77:1st • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS NECESSARY FOR THE ACQUISITION OF PARCELS 1 AND 2, AIRLINE SUBDIVISION SANITARY SEWER PROJECT; APPRO- PRIATING OUT OF THE NUMBER 162 FEDERAL -STATE GRANT FUND $3,030, OF WHICH $1,075 IS FOR ACQUISITION, $525 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES ..ELATED TO CLOSING, AND $1,430 IS FOR REIMBURSEMENT OF A PREVIOUS EXPENDITURE WHICH WAS PAID FROM THE 250 SANITARY SEWER BOND FUND FOR APPRAISAL SERVICES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to acquire Parcels 1 and 2, Airline Subdivision Sanitary Sewer Project, hereinafter more fully described, said Parcel 1 being acquired from Mrs. Emma Bunton and Parcel 2 being acquired from Georgia E. Parry Thompson: Parcel 1 Being a 10.0 foot wide strip of land for utility easement and access road out of Lot 20, Block B. Airline Subdivision, as shown by map of record in Volume 12, Page 18, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at a point on the northerly right -of -way line of Lyons Street, said point being the most southeasterly corner of abovementioned Lot 20 for the beginning corner of the tract of land herein described; Thence N. 600 55' 00" W., along the northerly right -of -way line of said Lyons Street, a distance of 10.0 feet to a point; Thence N. 290 01' E., along a line that is 10.0 feet westerly of and parallel to the easterly boundary line of said Lot 20, a distance of 166.10 feet to a point on the northerly boundary line of said Lot 20; Thence S. 600 55' 00" E., along the northerly boundary line of said Lot 20, a distance of 10.0 feet to a point which is the northeasterly corner of said Lot 20; Thence S. 290 01' W., along the easterly boundary line of said Lot 202 a distance of 166.10 feet to the place of beginning and containing 1,661.00 square feet of land, more or less. MICROFILMED' 13746 �s,+ #).71980- Together with a 30.0 foot wide temporary construction easement parallel to and adjacent to the westerly side of the above described utility ease- ment to be used for working room, storage of material and equipment. Said temporary construction easement shall be terminated within six (6) months after completion of the project for which the permanent utility easement is required. Parcel 2 Being a rectangular shaped tract of ]and out of Lot 15, Section 19, FLOUR BLUFF AND ENCIUAL FARM AND GARDEN TRACTS as shown by map of record in Volume A, Pages 41, 42, 43, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: ' Beginning at a point in the easterly boundary line of abovementioned Lot 15, said point being the northeast corner of Lot 20, Block B, Airline Subdivision, as shown by map of record in Volume 12, Page 18, Map Records, Nueces County, Texas, for the southeast and beginning corner of the tract of land herein described; Thence N. 600 54' 30" W., along the north boundary line of said Lot 20, a distance of 56.0 feet to a point which is the northwest corner of said Lot 20; Thence N. 290 00' E., a distance of 130.10' to a point in the south right -of -way line of a 75.0 foot wide drainage easement conveyed by R. P. Parry to Nueces County as recorded in Volume 766, Page 149, Nueces County, Texas, Deed Records; Thence s. 600 54' 30" E., along the south right -of -way line of said ease- ment, a distance of 56.0 feet to a point in the easterly boundary line of said Lot 15; Thence S. 290 00' W., along the easterly boundary line of said Lot 15, a distance of 130.10 feet to the place of beginning and containing 0.167 acres, more or less. 150 SECTION 2. That there is hereby appropriated out of the No. 162 Federal -State Grant Fund the sum of $3,030, of which $1,075 is for acquisi- tion of the aforesaid and hereinabove described parcels, $525 is for con- tingencies and incidental expenses'related to closing, and $1,430 is for reimbursement of a previous expenditure which was paid from the No. 250 Sanitary Sewer Bond Fund for appraisal services. SECTION 3, The necessity to acquire the aforesaid parcels in order that the sanitary sewer project may continue without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the QS' day of May, 1977. Note: The $11600.00 expenditure is for the acquisition of 2 parcels for the Airline Subdivision Sanitary Sewer Project; The $1,430.00 expenditure is for reimbruse- ment of a previous expenditure which was paid from the 250 Sanitary Sewer Bond Fund for appraisal Services.
