WHEREAS, the United States Senate has under consideration Senate
Bill 252 known as the Clean Air Act Amendment of 1977; and
WHEREAS, the United States House of Representatives is considering
similar legislation in H.R. 6161; and
WHEREAS, both bills contain a provision, the effect of which would
be to prohibit the issuance of construction and operating permits for the
expansion of existing and location of new industries in nonattainment areas,
unless existing industries in the area reduce emissions so that total cumu-
lative emissions, including those of the new or expanding industry, do not
increase; and
WHEREAS, the City of Corpus Christi has been found to be a non-
attainment area for particulate and ozone emissions even though the sampling
techniques and procedures used to make this determination do not, in the
opinion of this City, reflect the quality of air in Corpus Christi; and
WHEREAS, other major Texas cities have also been found to be non -
attainment areas for various emissions; and
WHEREAS, implementation of a trade -off provision would severely
restrict orderly industrial and economic growth and expansion in Corpus Christi
and other Texas cities, resulting in the loss of jobs and higher unemployment
rates contrary to the stated Congressional and Presidential policy of stimu-
lating economic growth and resulting jobs; and
WHEREAS, under the direction of the Texas Air Control Board, the
State of Texas and, in particular, the City of Corpus Christi and Nueces
County, have been leaders in the field of air pollution control with the City
and County having co- sponsored one of the first City- County Air Pollution
Control Units; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. The City Council strongly urges the United States Senate
and the United States House of Representatives to modify Senate Bill 252
and H.R. 6161, respectively, so as to allow the issuance of construction and

operating permits for the expansion of existing industries and the location
of new industries in nonattainment areas without requiring a direct offsetting
reduction in emissions by an existing industry to make the new or expansion
permit possible.
SECTION 2. The City Council further urges that the issuance of
construction and operating permits for expansion of existing and location of
new industries in nonattainment areas be allowed as long as there is in effect
a program which will assure that total allowable emissions in nonattainment
areas are reduced annually on an incremental basis so as to assure reasonable
progress toward attainment of the standards applicable in the nonattainment
area.
SECTION 3. The City Secretary is hereby instructed to forward copies
of this resolution to Senator Lloyd Bentsen, Senator John Tower, Congressman
John Young and all the other members of the United States Senate and the
United States House of Representatives.
SECTION 4. The necessity and urgency for the City Council of the
City of Corpus Christi to urge the United States Senate and the United States
House of Representatives to modify Senate Bill 252 and H.R. 6161, respectively,
so as to allow issuance of construction and operating permits for expansion
of existing industries and location of new industries in nonattainment areas,
all as aforesaid, creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordinance
or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared such emergency and necessity to exist, and
having requested the suspension of the Charter rule and that this resolution
be passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO
RESOLVED, this the aV' day of May, 1977.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
