AN ORDINANCE
CLOSING AND ABANDONING A 10'x70.l' UTILITY EASEMENT
IN LOT 4C; BLOCK 1, MARKS TRACT, AS MORE FULLY DESCRIBED
AND SET FORTH HEREINAFTER, SUBJECT TO THE DEDICATION OF
AN ALTERNATE EASEMENT; PROVIDING FOR SEVERABILITY; AND
DECLARING AN EMERGENCY.
WHEREAS, there exists a certain 10'x70.l' utility easement in
Lot 4C, Block 1, Marks Tract, as more fully set forth hereinafter, situated
in the City of Corpus Christi, Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easement upon the dedication
of an alternate easement, also more fully described hereinafter:
NOVI, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the utility easement in Lot 4C, Block 1, Marks
Tract, in the City of Corpus Christi, Nueces County, Texas, described as
follows:
Being a 0.0161 acre, more or less, tract of land out
of Lot 4 -C, Block 1, Marks Tract as shown by plat
recorded in Volume 42, page 124, Map Records, Nueces
County, Texas;
Beginning at a point which is an interior corner of
said Lot 4 -C, Block 1, and the west corner of Lot 4 -D,
Block 1, said Marks Tract, for the south corner and
point of beginning of this tract;
Thence N. 600 58' W. 70.10 feet to a point for the west
corner of this tract;
Thence N. 290 02' E. 10.00 feet to a point for the north
corner of this tract;
Thence S. 600 58' E. 70.10 feet to a point in the north-
west boundary line of said Lot 4 -D, Block 1, for the east
corner of this tract;
Thence along said northwest boundary line of Lot 4 -D,
Block 1, S 29° 02' W. 10.00 feet to the point of beginning,
be and the same is hereby closed for public use and every municipal purpose,
and abandoned to the owners of the abutting property in accordance with the
laws of the State of Texas, and for the service and interest of the inhabi-
tants of the City of Corpus Christi, Texas, subject to dedication of an
alternate easement, described as follows:

Being a tract or parcel of land consisting of 0.0904
acres, more or less,out of Lot 4 -B, Block 1, Marks Tract,
as shown by plat recorded in Volume 42, page 124, Map
Records of Nueces County, Texas;
Beginning at a point in the northwest right of way line
of Embassy Drive, said point being the south corner of
Lot 4 -C, Block 1, said Marks Tract, and the east corner
of said Lot 4 -B, Block 1, and the east corner and point
of beginning of this tract;
Thence along said northwest right of way line of Embassy
Drive, S. 29° 02' W. 10.00 feet to a point for the
south corner of this tract;
Thence N. 60° 58' W. 393.7 feet to a point in the north-
west boundary line of said Lot 4 -B, Block 1, for the west
corner of this tract;
Thence along the northwest boundary line of said Lot 4 -B,
Block 1, N. 29° 02' E. 10.00 feet to a point for the
north corner of this tract;
Thence along the common boundary line of said Lot 4 -B, Block 1,
and said Lot 4 -C, Block 1, S. 60° 58' E. 393.7 feet to the
point of beginning.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction,
it shall not affect any other section, paragraph, subdivision, clause,
phrase, word, or provision of this ordinance, for it is the definite
Intent of this City Council that every section, paragraph, subdivision,
clause, phrase, word or provision hereof be given full force and effect
for its purpose.
SECTION 3. The fact that the public convenience and necessity
would be better served by the closing of the aforesaid easement creates
a public emergency and an imperative public necessity requiring the sus-
pension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council,
and the Mayor, having declared such emergency and necessity to exist,

having requested the suspension of the Charter rule and that this ordinance
take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO ORDAINED, this the 0/ day of June, 1977.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or.requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of.the City
Council.
