HomeMy WebLinkAbout13789 ORD - 06/15/1977jkh:6- 14- 77;lst AN ORDINANCE CLOSING AND ABANDONING THE EXISTING TRIANGULAR PORTION OF A 10 -FOOT UTILITY EASEMENT, MORE FULLY DESCRIBED HEREINAFTER, LOCATED ON LOT 1A, BLOCK 4, CAROLYN HEIGHTS NO. 3; SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a certain small triangular portion of a 10 -foot utility easement in Lot IA, Block 4, Carolyn Heights No. 3, situated in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advan- tageous to the City of Corpus Christi to abandon said easement: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the existing small triangular portionof a 10 -foot utility easement located in Lot IA, Block 4, Carolyn Heights No. 3, situated in the City of Corpus Christi, Nueces County, Texas, being more particularly described hereinafter, be and the same is hereby closed for public use and every municipal purpose and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Nueces County, Texas. Said utility easement being abandoned is more particularly described as follows: Being a triangular shaped utility easement out of Lot ]A, Block 4, Carolyn Heights Unit 3, a map of which is recorded in Volume 41, pages 134, 135, Map Records of Nueces County, Texas: BEGINNING at the South corner of an existing two story brick house in said Lot lA for the South corner of this ease- ment from which point the South corner of said Lot lA bears South 35 °02140" East, 18.50 feet and South 65 °00'00" West, 17.28 feet; THENCE North 35 °02'40" West, with the Southwest facing of said brick house, 1.95 feet to a point for the West cor- ner of this easement; THENCE South 61 °30100" East, through said brick house 2.18 feet to a point on the Southeast facing of said brick house for the East corner of this easement; THENCE South 54 °57'20" West, with said Southeast facing 0.97 feet to the POINT OF BEGINNING, containing 1.00 square foot of land. 0 7980 13'78 SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introductionbut that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the�_day of June, 1977.
