HomeMy WebLinkAbout13792 ORD - 06/15/1977• jkh:6- 13 -77; 1st ///JJJ ///JJJ• TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE COASTAL BEND COUNCIL OF GOVERNMENTS FOR PARTICIPATION IN THE COG'S GRANT APPLICATION TO THE CRIMINAL JUSTICE DIVISION FOR THE INSTALLATION OF HIGH -SPEED TELETYPE UNITS FOR THE POLICE DEPARTMENTS IN THE 12- COUNTY COG AREA, ALL AS MORE FULLY SET FORTH IN THE CONTRACT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "A ", AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to execute a contract with the Coastal Bend Council of Governments for partici- pation in the COG's grant application to the Criminal Justice Division for the installation of high -speed teletype units for the police departments in the 12- county COG area, all as more fully set forth in the contract, a substantial copy of which is attached hereto, marked Exhibit "A ", and made a part hereof. SECTION 2. The necessity to authorize execution of the aforesaid contract at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Major having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the_&:I_day of June, 1977. I, ,. • AGREEMENT THE STATE OF TEXAS Q COUNTY OF NUECES p WHEREAS, the City of Corpus Christi, hereinafter referred to as "CITY ", wishes to participate in the Coastal Bend Council of Governments', hereinafter referred to "CBCOG ", high speed teletype project designed to improve Coastal Bend law enforcement agencies with the acquisition of new, improved high speed video (CRT) telecommunications terminals to replace existing teletype units; and WHEREAS, Criminal Justice Division funding is available to defray 65% of the purchase price and the first year maintenance cost of the new terminal equipment: NOW, THEREFORE, THIS AGREEMENT IS ENTERED INTO BETWEEN the City and CBCOG: 1. City authorizes CBCOG to submit a grant application to the Criminal Justice Division and to execute a contract with International Communications Corporation for the purchase and first year maintenance of one high -speed video (CRT) terminal device. 2. The CBCOG will submit a grant application to the Criminal Justice Division for the purchase and maintenance of said device. Upon approval of the grant application by the Criminal Justice Division, the CBCOG will contract with International Communications Corporation for the purchase, installation and maintenance of the device. 3. The CBCOG as recipient of the grant will issue all purchase orders for the purchase and installation of the high speed video terminal device. 4. The CBCOG will not approve payment of any bills to International Communications Corporation until the City certifies that the high speed video terminal device is installed and operating according to manufacturer's specifications and warranty. 5. Upon completion of installation and checkout of their device and certification of satisfactory completion by the City, the device shall become the property of City. After termination of the grant, the City • will maintain said device in operating condition for useful life of the device. 6. The City agrees to pay the 15% cash match required for City's portion of the grant application to the Criminal Justice Division for the purchase and first year maintenance of said device. Marvin Townsend, City Manager COASTAL BEND COUNCIL OF GOVERNMENTS By Corpus Christi, f9xas day of , 1921— TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced. and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
