HomeMy WebLinkAbout13796 RES - 06/15/1977F • THE STATE OF TEXAS COUNTY OF NUECES CITY OF CORPUS CHRISTI On this the 15th day of June, 1977, the City Council of the City of Corpus Christi, Texas, convened in A SMCigL RequAttz Meeting, with the following members of said Council and officials of said City present, to -wit: Jason Luby, Eduardo De Ases David Diaz Ruth Gill Bob Gully Gabe Lozano, Sr. Edward L. Sample R. Marvin Townsend, J. Bruce Aycock, Harold F. Zick, Bill G. Read, Alton T. White, Jr., Mayor Mayor Pro -Tem Councilmen City Manager City Attorney Director of Finance City Secretary Tax Assessor - Collector with the following absent: NOME constituting a quorum, at which time the following among other business was transacted: se-MY US 0411 presented for the consideration of the Council a resolution. The resolution was read by the City Secretary. The Mayor presented to the Council a communication in writing pertaining to said proposed resolution, as follows: "Corpus Christi, Texas "TO THE CITY COUNCIL Corpus Christi, Texas Gentlemen: The public importance and pressing need for the permanent improvements to be constructed by the use of the pro- ceeds of bonds contemplated to be sold pursuant to an offering made by an Official Statement to be authorized, ratified and approved by a resolution create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring resolutions to be considered and voted upon at three regular meetings. I, therefore, request that the City Council adopt the proposed resolution authorizing, ratifying and approving the use of said Official Statement as an emergency measure. You will please consider this request in connection with the resolution which is to be introduced for adoption by the City Council on this subject. 1-3796 "Yours very truly, /s/ Jason Luby Mayor" Councilman AsEs moved that the Charter provision prohibiting resolutions from being adopted finally on the date introduced be suspended for the reasons stated in the written request of the Mayor and stated in the emergency clause of the resolution. The motion was seconded by Councilman GUIIeY The motion was carried by a unanimous vote by the City Council, viz.: AYES: All present voted Aye. NAYS: None. This was done. The Mayor announced that the resolution has been adopted. The resolution is as follows: ij ,► I RESOLUTION APPROVING THE FORM OF THE OFFICIAL STATEMENT PERTAINING TO CITY OF CORPUS CHRISTI, TEXAS, GENERAL IMPROVEMENT BONDS, SERIES 1977 -A, AND AUTHORIZING, RATIFYING AND APPROVING THE OFFICIAL STATEMENT AND THE USE THEREOF IN THE OFFERING AND SALE OF SAID BONDS WHEREAS, the City of Corpus Christi is authorized ';to issue and sell its bonds heretofore approved at an elec- I tion held December 9 1972 all pursuant to the Constitution ;'.and laws of Texas; and 9 WHEREAS, it is the desire of the City Council that the Official Statement pertaining to certain of said bonds ,idesignated City of Corpus Christi, Texas, General Improvement Bonds, Series 1977, and the use of said Official Statement should be duly authorized, ratified and approved. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF I � 'CORPUS CHRISTI, TEXAS: 1. That the Official Statement, including the Official ;Notice of Sale, as set forth herein is hereby approved as to (form and content. 2. That the use of the Official Statement and all (addenda, if any, thereto in the offering and sale of said bonds ris hereby authorized, ratified and approved. 3. City Attorne I(�'7 City of Corpus Christi Corpus Christi, Texas 1591day of J UDC , 19_-7— TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
