HomeMy WebLinkAbout13824 ORD - 07/06/1977JKH:hb:7 /6/77_ AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE CORPUS CHRISTI AREA OIL SPILL-CONTROL - ASSOCIATION FOR THE PURPOSE OF PROVIDING COVERAGE TO THE ASSOCIATION'S EMPLOYEES UNDER THE CITY'S GROUP HEALTH INSURANCE POLICY, IN SUBSTANTIALLY THE FORM ATTACHED HERETO AND MADE A PART HEREOFi, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a contract with the Corpus Christi Area Oil Spill Control Association for the purpose of providing coverage to the Association's employees under the City's group health insurance policy, all as more fully set forth in the contract, a substantial copy of which is attached hereto, marked Exhibit "A ", and made a part hereof. SECTION 2. The necessity to immediately enter into the afore- said contract in order to effect the terms thereof creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of it's introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of July, 1977. Lti U Assistant City Attorney MAY ` THE CITY OF CORPUS CHRISTI, TEXAS ��824 MICROFILMED JUL Q 7 1980 CONTRACT THE STATE OF TEXAS COUNTY OF NUECES This contract, by and between the Corpus Christi Area Oil Spill Control Association, hereinafter referred to as "Association ", and the City of Corpus Christi, Texas, a municipal corporation, hereinafter referred to as "City ", W I T N E S S E T H : WHEREAS, the Association is desirous of providing group hospitalization coverage to its employees, and WHEREAS, the City is-enabled, under its present group health insurance contract, to designate Oil Spill employees as City employees for purposes of joining the City employee group contract, and WHEREAS, City and Association have so agreed. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that City and Association do enter into the following agreement: I In consideration of the City designating Association employees as City employees for the sole purpose of group hospitalization insurance coverage, the Association agrees as follows: 1. To deliver to City by the first working day of each month, in advance, all payments for group health insurance to consist of both the employer's and employees` share of the subject month's premium. 2. The premiums paid by Association to the City shall be at the prevailing rate the City pays for its health insurance under its prevailing contract with the insurance carrier. 3. All required insurance forms will be completed by the Association and forwarded to the appropriate City department for processing. Such forms include claim forms as well as employee coverage change forms. 4. Association will provide the City, on a monthly basis, in conjunction with its payment to the City, a statement showing the amount of each employee's and the total employer's contribution for group health insurance coverage for that particular month. 5. Association agrees to inform the City at the time of termination of any Association employee so that coverage for that employee can be timely terminated. II It is agreed this contract may be terminated by either party with a 30 -day notice of intent to terminate. In the event the insurance carrier desires to terminate Association coverage, no notice is required. ATTEST: City of Corpus Christi By City Secretary R. Secretary 23824 l Corpus Christi Texas F� µday of , 19 77 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of•the City Council.
